Martin A. Folliard

Marty Folliard is an associate and advises health care providers and health technology clients on regulatory and compliance matters, including privacy and security, digital health, fraud and abuse, licensure, clinical research, and commercial contracting. He represents a broad spectrum of clients within the health care ecosystem, including hospitals and health systems, academic medical centers, pharmacies, physician practices, clinical laboratories, telehealth companies, and medical device manufacturers. Marty has extensive experience assisting clients with HIPAA compliance initiatives, including the development of policies and procedures, structuring and negotiating health data sharing and data protection agreements, and managing data breach response efforts. Marty also assists clients with navigating complex federal and state requirements related to digital health, including corporate practice of medicine (CPOM) restrictions, electronic prescribing of controlled and non-controlled substances, and reimbursement.

Prior to joining the firm, Marty served as the compliance officer for a dental school in North Carolina. In this role, Marty developed and managed a comprehensive compliance and risk management program to address a wide range of regulatory issues including HIPAA privacy, health care fraud and abuse, Affordable Care Act Section 1557 non-discrimination, electronic prescribing of controlled substances, and professional liability. Marty also centralized the school’s contract review and negotiation process and advised on strategic initiatives.
