Mr. Dunlop is an intellectual property lawyer and a patent attorney.

Mr. Dunlop has a broad range of experience protecting and enforcing intellectual property rights, and is a registered patent attorney in Australia and New Zealand.

Mr. Dunlop has a wealth of experience acting for clients in complex patent litigation and patent opposition proceedings, and regularly advises on patentability, validity and infringement. Mr. Dunlop holds a Bachelor of Science (majoring in physics and mathematics) and a Masters of Intellectual Property Law, and combines his degrees and technology experience to assist clients to protect and enforce their patent rights in relation to a broad range of technical areas.

He has also developed and enforced brand protection strategies for trade mark and design owners, and providing contentious and non-contentious advice in relation to all aspects of intellectual property law.

Mr. Dunlop has extensive experience prosecuting trade mark applications and opposition proceedings with IP Australia, and has managed multinational trade mark portfolios for high profile brands.

Mr. Dunlop has represented clients in legal proceedings concerning patent, trade mark, design and copyright infringement, as well as the misuse of confidential information, misleading and deceptive conduct and passing off. In addition, he has experience prosecuting domain name complaints.

Professional Background

Prior to joining K&L Gates, Mr. Dunlop worked in the intellectual property group of a large national Australian law firm and a boutique intellectual property law firm based in Melbourne.

Speaking Engagements

Mr. Dunlop has presented seminars on Australian trade mark law, copyright law and patent law, including as a guest lecturer in the undergraduate Intellectual Property Law course at La Trobe University in Melbourne.
  • Acting for a specialty chemicals and polymers company in patent validity and infringement proceedings in the Federal Court of Australia, and in opposition proceedings before the Australian Patents Office, as well as coordinating with legal teams in other jurisdictions.
  • Acting for a generic pharmaceutical company in defending claims of patent infringement and prosecuting a cross-claim for invalidity.
  • Acting for a global pharmaceutical company, with operations in Australia, in relation to a number of patent infringement disputes relating to its patent and the altering of the alkaloid composition. The dispute has involved allegations of infringement in Australia, India, Europe, South Africa and the United States.
  • Managing, enforcing and prosecuting the trade marks portfolio of an international entertainment provider in Australia, South East Asia and Europe.
  • Successfully enforcing Notices of Objection through the Australian Customs Service for a number of clients, resulting in the destruction of imported counterfeit goods.
  • Acting for a number of clients in trade mark opposition proceedings before the Australian Trade Marks Office and on appeal to the Federal Court of Australia.
  • Acting for an Australian technology company in successful Federal Court of Australia proceedings against former employees involving trade mark infringement, misleading and deceptive conduct and misuse of confidential information.
