Mr. Fay is a commercial litigation and insolvency lawyer with particular expertise in corporate insolvency, personal insolvency, restructuring, loan recovery, security enforcement and banking and finance litigation. He assists in advising Australia's largest banks and financial institutions, listed and unlisted companies and Australia's preeminent insolvency accounting firms.

Mr. Fay advises clients on all aspects of insolvency across a range of sectors, including retail, manufacturing, property and natural resources.

  • Assisting in advising a large Australian retail client in relation to a solvent wind-down of its retail operations, including the controlled exit of from all retail sites.
  • Assisting in advising major Australian banks in relation to enforcing various securities held in respect of borrowings advanced to corporate groups, and when necessary, assisting with documenting and implementing workout strategies.
  • Assisting in advising in various court proceedings, including a Supreme Court insolvency related matter which involved defending substantial unfair preference payment claims.
  • Regularly advising insolvency accountants on various insolvency specific and general commercial issues.
