Andrew Glass advises businesses in achieving integrated, multi-disciplinary solutions to managing risk. Mr. Glass and his project teams work closely with clients’ business lines, and their legal, compliance, and information technology departments, to navigate complex regulatory areas. Mr. Glass provides regulatory-compliance advice and policy and procedure review. He oversees audits and internal investigations and responds to government investigations. Mr. Glass defends complex litigation including class actions. He counsels companies in the financial services, energy, media and telecommunications, manufacturing, and consumer product industries. His multi-faceted approach to problem-solving delivers seamless solutions to clients’ legal challenges.

REPRESENTATIVE EXPERIENCE

Litigation Defense and Risk Assessment

  • Devise holistic defense strategies for leading national energy consortium, national bank, national manufacturer, and national media and entertainment company in connection with high-risk, repeat litigation matters
  • Defend leading national energy consortium in putative nationwide Telephone Consumer Protection Act (TCPA) class actions
  • Act as national coordinating counsel for leading national bank in defense of multiple, high-exposure Fair Housing Act litigation matters
  • Act as national coordinating counsel for leading financial services company in bankruptcy-related matters
  • Advise leading financial services companies in connection with proposed mergers and acquisitions of risk of pending litigation involving target businesses

Regulatory-Compliance Advice

  • Advise leading national energy consortium regarding reorganizing business operations and vendor contracts for compliance with TCPA and do-not-call registry regulations 
  • Advise leading national banks regarding configuring servers and dialing technology for compliance with TCPA automatic telephone dialing system
  • Design and implement TCPA compliance regimes for national loan servicer, national media and entertainment company, and national wireless carrier
  • Develop 50-state compliance plans for state-chartered banks regarding state telemarketing laws
  • Advise national loan servicer on compliance matters arising under Fair Credit Reporting Act (FCRA) and Fair Debt Collection Practices Act (FDCPA)
  • Development customer disclosures required under FCRA, FDCPA, and Truth in Lending Act, and TCPA
  • Prepare amicus briefs to U.S. Supreme Court and federal trial courts for financial services companies on compliance impact of Fair Housing Act and Equal Credit Opportunity Act Litigation
  • Prepare comment letters to U.S. Department of Housing and Urban Development (HUD) regarding Fair Housing Act disparate-impact rule
  • Advise health care consulting firm on insurance coverage issues arising under ongoing TCPA litigation

Audits and Investigations

  • Top-to-bottom audit for national mortgage servicer of customer service operations regarding compliance with laws regulating customer contact and communication
  • Conduct internal investigations for national mortgage servicing clients regarding mortgage foreclosure practices
  • Represent national mortgage lenders in HUD False Claims Act investigations
  • Represent national mortgage lenders in HUD secretary-initiated Fair Housing Act investigations
  • Respond to civil investigative demands by Consumer Financial Protection Bureau (CFPB) and state attorneys general
  • Represent national loan servicers in CFPB enforcement actions

Professional Background

Before joining K&L Gates in 1998, Mr. Glass served as law clerk to Chief Judge Paul J. Barbadoro of the United States District Court for the District of New Hampshire. Mr. Glass is active in providing pro bono legal representation and is the pro bono coordinator for K&L Gates’ Boston office.
