Andy Stanton is an experienced litigator with first-chair trial, arbitration, and appellate experience. Mr. Stanton has successfully tried cases in state and federal courts in numerous jurisdictions, has argued multiple appeals, and has represented clients before a number of different arbitral tribunals. Mr. Stanton has represented clients spanning a broad range of industries, including manufacturing, energy, mining, metals, specialty chemicals, industrial equipment, financial services, health care and pharmaceuticals, and consumer products.

Mr. Stanton is resident in the firm’s Pittsburgh office, where he currently serves as the Pro Bono Coordinator and is a member of the Associate Development and Hiring Committees.

Insurance Coverage Litigation
Mr. Stanton has litigated on behalf of policyholders seeking insurance coverage for third party bodily injury and property damage claims as well as first party property damage and business interruption claims. In 2013, Mr. Stanton was lead trial counsel for U.S. Silica Company in a West Virginia state court case in which U.S. Silica sought insurance coverage for defense and indemnity costs arising out of third party silica bodily injury claims. U.S. Silica obtained a jury verdict plus an award of attorneys' fees and interest, for a total judgment of approximately $18 million. In addition to litigating first and third-party insurance coverage disputes, Mr. Stanton has advised clients with respect to insurance issues that arise in connection with corporate transactions and restructurings, D&O coverage, investment management coverage, professional liability coverage and fiduciary liability coverage.

Transactional Litigation
Mr. Stanton has represented clients in disputes arising out of corporate transactions, including post-closing purchase price and working capital adjustment disputes, claims for indemnification (including escrow and non-escrow claims), and earn out disputes. In the area of transactional litigation, Mr. Stanton has assisted clients in avoiding litigation by achieving favorable settlements, has obtained dismissal of multiple complaints, and has successfully represented clients in jury trials, non-jury trials and private arbitration.

Commercial Disputes
Mr. Stanton has represented clients in the defense and prosecution of claims for breach of contract and business torts, including tortious interference, fraud, negligent misrepresentation, unfair competition and theft of trade secrets. In the area of commercial disputes, Mr. Stanton has obtained dismissals, favorable summary judgment rulings, and has represented clients in jury trials and arbitration.

Government Enforcement
Mr. Stanton has represented clients in connection with investigations by the Department of Justice and other governmental agencies, and has conducted internal investigations and advised clients with respect to issues arising out of the federal False Claims Act (“FCA”) and Foreign Corrupt Practices Act, and has represented clients in FCA qui tam litigation.
