Georgia Pacific, LLC v. Farrar,69 A.3d 1028, 432 Md. 523 (Md. 2013).  K&L Gates lawyers represented an amicus curiae supporting the reversal of an intermediate appellate court’s determination that a company that manufactured products containing asbestos did not owe a duty to warn family members of persons using the product.  The Maryland Court of Appeals agreed and reversed.
Gillard v. AIG Ins. Co., 15 A.3d 44, 609 Pa. 65 (Pa. 2011).  K&L Gates lawyers served as counsel to amicus curiae seeking reversal of an intermediate appellate court’s restrictive interpretation of the attorney-client privilege.  The Pennsylvania Supreme Court agreed with the position asserted by the amicus curiae and quoted at length from the K&L Gates brief.
Kilmer v. Elexco Land Services Company, 990 A.2d 1147 (Pa. 2010).  K&L Gates lawyers represented Southwestern Energy Production Company and Elexco Land Services Company before the Pennsylvania Supreme Court in a case of first impression determining whether Pennsylvania’s Minimum Royalty Act should invalidate thousands of oil-and-gas leases.  The court agreed with K&L Gates’ argument that the statute should be interpreted in a way that preserved the leases.
Justin Fuss-McCullough et al. v. Nike, Inc., et al., 2010 WL 2560407, (Ca. Super. 2010).  K&L Gates lawyers won a major victory for firm client Nike when the California Court of Appeal unanimously affirmed a jury verdict in the first and only Nike-brand products liability case to go to trial.
Common Cause and League of Women Voters v. Commonwealth et al., 558 F.3d 249 (3rd Cir. 2009).  In an unusual case that was argued twice and that saw all the judges of a circuit court of appeals recuse themselves, K&L Gates lawyers obtained a decision affirming the dismissal of a civil-rights suit brought against leaders of all three branches of a state government by Common Cause and the League of Women Voters.
In re Volkswagen of Am. Inc., 545 F.3d 304 (5th Cir. 2008) (en banc)).  In a 10-7 decision based on arguments urged by K&L Gates lawyers, the Fifth Circuit issued a writ of mandamus ordering that Singleton v. Volkswagen be transferred from the Marshall Division of the Eastern District of Texas to the Dallas division of the Northern District of Texas.  This result helped to limit the infamous “rocket docket” of products-liability and intellectual-property cases in Marshall, Texas, where the federal district court had emerged as a magnet for such litigation.
Ballard v. Commissioner of Internal Revenue, 522 F.3d 1229 (11th Cir. 2008).  In a case closely followed by the tax bar, the Eleventh Circuit fully vindicated K&L Gates’ client against allegations by the Internal Revenue Service (IRS) that he participated in a complex kick-back and tax fraud scheme.  K&L Gates’ client ultimately received a refund from the IRS in excess of $15 million.
Stoneridge Investment Partners, LLC v. Scientific-Atlanta, Inc., 552 U.S. 148 (2008).  K&L Gates lawyers represented amicus curiae in one of the most important federal securities law cases to reach the Supreme Court.  Relying on arguments made in our brief, the Supreme Court rejected “scheme-liability” theories of plaintiffs' class-action lawyers who sought to bring federal securities fraud claims against a wide range of parties that deal with public companies, even if those parties never made a false representation to the plaintiffs in particular or to the public in general.
