Ms. Montgomery has more than 15 years' experience working in Australia and internationally with a focus on non contentious matters in the project management, construction, engineering and infrastructure project sectors.

Ms. Montgomery's extensive inhouse experience has provided her with a commercial approach to contract drafting, contract review, negotiation, strategic advice and management. She has also worked on a range of construction disputes both in Australia and Hong Kong.

Professional Background

Prior to joining K&L Gates, Ms. Montgomery worked inhouse as Senior Legal Counsel for Lendlease Engineering Pty Ltd, one of Australia's largest construction, infrastructure and property groups. In this role she provided legal advice, management and operational support to the inhouse legal practice. Ms. Montgomery has also worked inhouse at United Group Limited.

Achievements

Ms. Montgomery was a finalist for Special Counsel of the Year in the Lawyers Weekly Women in Law Awards (2015).

  • Reviewing and negotiating a large range of tenders for civil engineering and building works for Lendlease (up to AUD550 million) including earthworks, roads, bridges, water projects, hospitals, schools, shopping centres, rail and telecommunications, including Australian standard contracts, GC21 contracts, complex bespoke design and construct and construct only contracts.
  • Drafting and negotiating a suite of standard services agreements (MOU, Tender Services Deed and Professional Services Deed) for Lendlease to use with key design consultants.
  • Drafting and negotiating joint venture agreements, supply agreements and subcontract agreements for Lendlease.
  • Providing extensive support to Lendlease's operations team during the construction, defects liability period and post defects liability period on a range of engineering and building contracts.
  • Advising on the acquisition by United Group Limited of the Australian and New Zealand arm of Alstom Transport, including rail, infrastructure systems and information solutions contracts.
  • Reviewing and negotiating the alliance contract on behalf of United Group Limited for the Perth Desalination Project.
  • Acting on a dispute involving Lendlease's joint venture to undertake earth and civil works for the Wiggins Island Coal Export Termination (WICET) at Gladstone. The contract was the subject of a major dispute with the client for an estimated value of AUD290 million. The dispute was the subject of adjudication.
  • Managing various disputes in the Supreme Court in New South Wales, Victoria and Hong Kong, including claims for extensions of time and variations, defending claims for liquidated damages and defects.
  • Acting for Lendlease Engineering in the negotiations of the AUD160 million Dingo to Bluff Duplication for the Wiggins Island Rail Project with Aurizon.
  • Assisting the Abigroup (now Lendlease Building) project team on the Cairns Base Hospital Redevelopment Managing Contractor project and the Queensland Children's Hospital with issues including extension of time claims and variations.
  • Assisting the Lendlease Engineering project team on the Wiggins Island Balloon Loop project (Segment 1) with Aurizon.
  • Assisting Lendlease Engineering on a range of tenders for Queensland, including a tender for the Corso, North Lakes with Moreton Bay Regional Council and Moura West Upgrade (Segment 8) with Aurizon.
