Mr. O'Sullivan is a lawyer in the restructuring and insolvency group. He provides advice to a range of companies, banks, and insolvency practitioners. He advises in relation to recovery matters, winding ups and enforcement matters. Mr. O'Sullivan also has a wide range of experience in general commercial litigation matters.

  • Advising clients regarding contested "just and equitable" winding up applications under the Corporations Act 2001 (Cth).
  • Providing advice to financial institutions regarding the enforcement of their rights under various facilities and the recovery of secured assets.
  • Advising insolvency practitioners and corporate clients regarding preferential payment claims.
  • Providing advice to financial institutions and insolvency practitioners regarding their duties and obligations in enforcement and winding up processes.

Litigation and Dispute Resolution
  • Acting for plaintiffs in $7 million claim by property developer against another property developer in respect of breach of contract, breach of fiduciary duties, complex quantum and expert evidence issues
  • Acting for plaintiff property group in $78 million dispute against large telecommunications company, alleging breach of contract, breach of fiduciary duties and breach of confidence, complex quantum issues
  • Defending a director of a corporate trustee in a $10m claim as a result of the failure of a large property development;
  • Advising a company officer accused of pre-contractual misrepresentations, $2 million claim
  • Acting in shareholder dispute involving oppression claim under Corporations Act 2001 (Cth)
  • Acting for unlisted public company in land tax dispute with Valuer-General;
  • Acting for employers in numerous unfair dismissal applications and representing the employers in conciliation conferences.
