Ms. Carroll is an experienced trial attorney in the state and federal courts. She has also handled many matters in the administrative and appeals courts. She practices in both North and South Carolina. In her career, Ms. Carroll has handled a wide array of litigation for a variety of clients, ranging from transportation companies and manufacturing operations to hospitals and commercial enterprises.

Ms. Carroll had handled numerous product liability, personal injury, and malpractice lawsuits. She represents management in a wide array of employment matters related to wrongful termination, non-competition and trade secret actions, and occupational safety issues. She regularly assists banks and creditors, as well as other businesses and industries in complex business litigation.

Ms. Carroll regularly provides on-site counseling and training programs for clients and frequently serves as coordinator and presenter for human resource professional organizations, medical and professional practices, industry councils and chambers of commerce on a variety of topics including employment and safety issues.
Product and Tort Litigation
  • Successfully defended textile equipment manufacturing operation brought by a contractor whose hand was amputated during maintenance of a machine that was allegedly unguarded and unsafe.
  • Represented propane company sued by a Church on the claim that the heating system was improperly installed resulting in a fire that destroyed the Church.
  • Represented trucking company arising from an interstate accident allegedly caused by negligent operation that resulted in two deaths and serious injuries to three other passengers.
  • Represented asbestos manufacturer in claims made by school district that sought damages for the abatement of asbestos in the district.
  • Represented chemical plant in a claim regarding a serious automobile accident that was allegedly caused by the release of noxious gas over an interstate highway.
  • Successfully defended an electrical contractor arising from the malfunction of a recently serviced bucket truck causing it to collapse resulting in the death of a contractor using the equipment.

Employment Related Litigation
  • Defended international manufacturer of float glass and glass products in a jury trial, which resulted in a defense verdict. The suit was brought by an African American employee who asserted that he was discriminated against because of his race when he was terminated for violation of company policy that prohibited use of language that was deemed to be discriminatory in nature.  
  • Prosecuted violation of non-compete and unfair trade practices lawsuit on behalf of national insurance brokerage group against competitor that lead to substantial settlement payment of numerous actions across the country [we handled the matter in SC only].
  • Successfully defended North Carolina medical practice against claim by former employee who claimed her termination after her medical leave was a violation of public policy.
  • Successfully defended a self-insured international manufacturer of filters and filtration devices and prevented any recovery of benefits in two separate claims brought by employees who sustained permanent and totally disabling back injuries who asserted that their injuries were the result of on-the-job injuries.  
  • Successfully defended a self-insured manufacturer of vending machines in a claim filed by a long time employee that his depression was the result of the unusual and extraordinary circumstances of his employment that required him to assume greater supervisory duties.  
  • Developed OSHA compliance audits for clients and defended OSHA charges through the appeals level. Served as employment law counsel in various mergers and acquisitions for Kennedy Covington clients.

Real Estate Foreclosure, Remedies and Enforcement Litigation
  • Represented secured lender in successful summary judgment motion with respect to borrower's asserted defenses based upon tenant bankruptcy.
  • Represented secured lenders in mortgage foreclosure actions involving substantial subdivision developments in Greenville, Spartanburg, Charleston, Horry, Lexington, Berkeley, and Dorchester counties in South Carolina.
  • Represented lender to successfully attain injunction to prevent recreational vehicle dealership from removing or otherwise disposing of assets prior to declaring bankruptcy.
  • Representing national bank in a claim in numerous lawsuits centering on claims fraud related to the speculative sales of development lots.
  • Represented manufacturer of construction material in a class action suit brought by homeowners' groups seeking claims for unfair trade practices and fraud arising from the construction of condominium units on the South Carolina coast.
