Mr. Carton is a partner who dedicates his practice to complex civil litigation, primarily in the areas of product liability, commercial litigation and employment. He has appeared as lead trial counsel in twenty-seven trials. He has taken eighteen verdicts, ten of which were jury verdicts. His trials have been in a broad range of areas including: civil rights, catastrophic personal injury, eminent domain, consumer fraud and complex insurance sales practices litigation. Mr. Carton has been certified for over five years by the Supreme Court of New Jersey as a Civil Trial Attorney. He also sits on the Board of Trustees for the Trial Attorneys of New Jersey (TANJ) and is a Fellow and Barrister (Order of Veritas) of the Litigation Counsel of America.

Mr. Carton routinely litigates complex product liability and other civil matters in state and federal courts throughout New Jersey and across the nation. He has appeared pro hac vice in state and federal courts in numerous states including: California, Florida, Louisiana, New York, North Carolina, Pennsylvania and Tennessee.

In the product liability arena, Mr. Carton regularly defends companies in state and federal courts across the country, often on a nationwide coordinated basis, against claims for catastrophic personal injury, property, consumer fraud and other damages alleged to arise from defective pharmaceutical, medical, consumer, industrial and commercial products.

Mr. Carton also has significant experience coordinating class actions related to allegedly defective consumer and building products. He also has experience defending shareholder derivative class actions.

In addition to his trial practice, Mr. Carton has extensive and varied appellate experience, including emergent applications and interlocutory appeals. He has successfully argued appeals of claims ranging from civil rights to eminent domain and redevelopment.

Mr. Carton has been selected as a New Jersey Super Lawyer in 2011, 2012 and 2013, a listing of attorneys who have attained a high-degree of peer recognition and professional achievement.

Professional Background

Prior to joining K&L Gates, Mr. Carton was a partner at a Newark law firm, where he focused on product liability, labor and employment, and construction issues.

Mr. Carton clerked for the Honorable Daniel J. O’Hern (ret.) of the New Jersey Supreme Court.
