Mr. McDonough represents banks, lenders, servicers, and others in complex enforcement and regulatory compliance matters related to consumer financial products. He concentrates his practice representing clients in federal and state investigations and enforcement actions, including fair lending investigations before DOJ, HUD, and state enforcement officials.
From a regulatory compliance perspective, Mr. McDonough advises clients on compliance with or exemptions to federal and state laws regulating consumer finance, including laws related to mortgage lending, mortgage servicing, real estate appraisals, and debt collection. He also counsels clients in connection with investments or acquisitions related to mortgage loans, consumer loans and other consumer financial products, including performing specialized regulatory compliance due diligence.
Mr. McDonough’s practice extends to a variety of federal and state laws, including the Fair Housing Act, the Equal Credit Opportunity Act, the Dodd-Frank Act, the Fair Debt Collection Practices Act, the Home Mortgage Disclosure Act, the Fair Credit Reporting Act, the Real Estate Settlement Procedures Act, the False Claims Act, state UDAAP/fair lending laws, state debt collection laws, and state real estate appraisal laws.
Before entering the legal profession, Mr. McDonough was a journalist at a variety of publications, including Business Week Online, and also served as the director of communications for a health care trade association.
