Eloise Nagle brings a refreshing sense of calmness and a great ability to translate complex issues into simple solutions in every area of her extensive practice.

Ms. Nagle understands what clients want and she demonstrates judgement and foresight which engenders a huge level of trust from clients.

Ms. Nagle has a particular interest in workplace health and safety compliance and she has worked on a number of complex safety prosecutions under the Western Australian mines safety legislation and occupational safety and health legislation.

Professional/Civic Activities

Ms. Nagle is a member of the Industrial Relations Society of Western Australia and a mentor to young female lawyers as part of the University of Western Australia "Women in the Law Mentor Scheme."

She also provides regular pro bono support to the Fair Work Commission Workplace Advice Service.

Speaking Engagements

Ms. Nagle is a regular presenter at industry and client conferences in the area of labour, employment and workplace safety. Ms. Nagle has sat as a tribunal member for the Tennis West Tribunal and she has delivered complaint management and mediation training for the WA Sports Federation (WASF).

Ms. Nagle has lectured in the unit of Human Capital at the University of Western Australia on the topic "Investigating a Workplace Incident". She also delivers Registered Manager training to mining clients to provide advice and assistance regarding their legal obligations under the Western Australian mines safety and occupational health and safety legislation.

  • Assisting one of the world's largest mining companies in defending prosecutions in the Magistrates Court of Western Australia under the Western Australian mines safety and occupational health and safety legislation.
  • Providing innovative advice to one of the world's largest mining companies regarding the establishment of a new enterprise agreement in a subsidiary company and subsequently, assisting in bringing a group of crucial contractor employees "in house" under the new enterprise agreement.
  • Assisting with the drafting and negotiation of collective enterprise agreements in the mining, construction and finance industries.
  • Advising on and defending general protections claims in the Fair Work Commission and the Federal Circuit Court.
  • Advising on and defending unfair dismissal proceedings at the Fair Work Commission.
  • Advising on and defending denied contractual benefits claims in the Western Australian Industrial Relations Commission.
  • Drafting commercial and other employment related documentation including contracts of employment, consultancy agreements, release agreements, confidentiality and restraint of trade documents.
  • Advising on the application of industrial awards and enterprise agreements.
  • Advising on the termination of employment in various contexts.
  • Assisting with workplace investigations relating to discrimination, harassment and bullying allegations.
  • Advising corporations of their obligations under workplace health and safety laws.
  • Advising corporations with respect to investigations conducted by state safety regulators into workplace health and safety incidents.
  • Defending corporations with respect to prosecutions brought by the state safety regulator for breach of workplace health and safety laws.
