In many sectors, arbitration is now seen as the natural choice for the binding resolution of commercial disputes where companies or state entities enter into cross-border contractual relationships. Although arbitration can have some similarities to court litigation, it is a different process in which unique factors and considerations apply and where specific arbitration experience is of considerable benefit.  Our arbitration lawyers will help guide you through what, to some, can be an unfamiliar and daunting process.

International arbitration is a core activity of K&L Gates.  The wider Dispute Resolution group represents over one-third of the firm’s practice.  Within that, the International Arbitration practice includes over 100 lawyers spread across our offices globally, including in many of the world’s leading arbitration centers.

We have been involved in arbitrations in many countries across the world in Europe, Asia, and North, Central, and South America. We have extensive experience with all major international arbitration rules including those of ICC, LCIA, AAA/ICDR, ICSID, SCC, DIS, HKIAK, CIETAC, CAM Santiago, SIAC, trade associations (such as the RSA and FOSFA), and ad hoc arbitrations under the UNCITRAL Rules. We have also dealt with numerous investment treaty cases under Multilateral and Bilateral Investment Treaties acting on behalf of investors and sovereign states‬‪.

K&L Gates lawyers also are actively engaged in dispute avoidance and are regularly involved in a range of alternative dispute resolution mechanisms, including mediation, mini-trial, or bespoke forms of structured negotiations.

Represented a Western European state electricity company in a London-seated ICC arbitration involving a substantial claim for breach of contract on the sale of electricity generators.
Represented a worldwide oil and gas exploration and production company in a London-seated Bermuda Form arbitration in connection with recovery of losses, stemming from a crude oil spill at a refinery caused by Hurricane Katrina, from an insurance carrier.
Represented a Chinese contractor in a US$58 million HKIAC arbitration against a Hong Kong property developer regarding the construction of a residential development. English substantive law applied.
Represented a major French EPC contractor in a US$20 million SIAC arbitration arising out of disputes concerning a synthesis gas plant project in the Peoples Republic of China. English substantive law and Singaporean procedural law applied.
Represented the West Indies Cricket Board in ad hoc London-seated expedited arbitration proceedings in relation to the contractual dispute with its principal sponsor, Digicel, and Stanford LLC in connection with the “Stanford 20/20 for US$20 million” cricket match in November 2008.
Represented a world-leading constructor of offshore mobile drilling units and its Dutch subsidiary in arbitration in Singapore of €100 million plus dispute (extra work, extension of time) under an upgrade/refurbishment contract for a semi-submersible drilling unit.
Represented Western investors in a joint venture dispute with local partners in India. A London-seated, ICC arbitration has been favorably concluded by an award requiring the transfer of shares to our clients. A freezing order and anti-suit injunction were obtained from the English Commercial Court in support of the arbitration.
Represented an international distributor of petroleum products in obtaining a federal court confirmation of the US$640 million ICDR arbitration (seated in Houston, Texas) award previously obtained for the client in a refinery dispute with a South American oil company. The court confirmed the award, and ordered that the oil company pay the significant attorneys’ fees incurred by our client in obtaining the confirmation.
Represented a leading international paper and packaging group with its headquarters in Austria, in a Hamburg-seated DIS arbitration of a warranty claim under an SPA against a family-owned group of companies manufacturing and trading wood, pulp, paper, and packaging materials. The claim was valued at approximately €10 million.
Represented a distributor of nutritional supplements in a London-seated ICC arbitration. The governing law was Swiss law, and the claimant sought damages of circa US$25 million.
