Dave Osipovich is an experienced litigator who focuses his practice on high-stakes complex commercial disputes, as well as insurance recovery on behalf of policyholders. Mr. Osipovich has extensive first-hand experience with all phases of litigation, including initial fact investigations, large-scale e-Discovery collection, review and production, discovery motions, dispositive motions, and examination of witnesses (individual, corporate, and expert) at both trial and deposition.

Most recently, Mr. Osipovich led a team that obtained a complete defense award for a client in a commercial AAA arbitration involving breach of contract and fraudulent misrepresentation claims.

Mr. Osipovich’ s complex commercial litigation experience includes handling commercial lease disputes, commercial contract disputes, oil-and-gas disputes, construction disputes, and shareholder disputes. He has litigated cases involving breach of contract, fraud and misrepresentation, tortious interference, breach of duty of good faith and fair dealing, trespass, invasion of privacy, civil conspiracy, and product liability.

Mr. Osipovich’ s insurance experience includes recovering insurance proceeds for corporate policyholders under general liability policies, business interruption policies, employment practices liability policies, and excess workers compensation policies. He has handled coverage disputes involving third-party environmental damage claims, third-party toxic-exposure bodily-injury claims, wrongful termination claims, workers compensation claims, and first-party property claims.

Mr. Osipovich’ s clients include representatives of a wide variety of industries, including aerospace, telecommunications, software, energy, health care, and heavy manufacturing. He has represented both plaintiffs and defendants in state and federal courts in Pennsylvania, New Jersey, New York, Ohio, California, Illinois, Oregon, and Kentucky.

In addition to his core practice, Mr. Osipovich represents pro bono clients in Eighth Amendment prisoners’-rights cases.

Professional Background

Mr. Osipovich holds a doctorate in Philosophy from Vanderbilt University. Prior to pursuing his legal career, Mr. Osipovich published a number of articles in peer-reviewed academic journals, and held tenure-track teaching positions at Marist College and Eastern Washington University. He has also taught philosophy at Allegheny College and the College of William and Mary.

  • Represented energy company in suit brought by landowners involving breach of contract claim and environmental property damage claim; second-chair responsibility (case disposed of in client’s favor on summary judgment).
  • Represented appliance manufacture in consumer class action suit alleging bodily injury and product liability: primary responsibility for all written discovery, including electronic document collection, review and production (litigation ongoing).

Insurance Recovery
  • Represented military-aircraft-parts manufacturer in suit seeking insurance coverage under employment-practices liability policy for underlying claim of wrongful dismissal and retaliation: first-chair responsibility (case settled favorably for client).
  • Represented steel company in action against insurance carriers seeking insurance coverage for underlying third-party asbestos bodily-injury claims: shared primary responsibility for all discovery, took and defended over a dozen depositions, including 30(b)(6) depositions; researched and drafted dispositive motions; trial team member (case disposed of in client’s favor on summary judgment).
  • Represented advanced-composites manufacturer in suit against insurance carriers seeking insurance coverage for underlying third-party environmental property damage claims: primary responsibility for all written discovery, including multi-million-page document collection, review and production; took and defended over 30 depositions, including expert and 30(b)(6) depositions; primary responsibility for expert reports; primary drafter of motions for summary judgment and oppositions to insurers’ motions for summary judgment (case settled favorably for client).
