We served as lead counsel for ADT Corporation in a patent infringement case regarding the patents of home security and automation systems. The case settled on favorable terms.
We represented Neuralstem, Inc. in a decisive victory against its key competitor, StemCells, Inc., in a large patent infringement case. The entire case was dismissed with prejudice. This judgment is the product of nine years of litigation, two federal judges, and multiple United States Patent and Trademark Office re-examinations.
We represented Eastman Kodak Company in litigation with Apple Computer, Inc. and Research in Motion Corporation in two simultaneous cases before the International Trade Commission and simultaneous federal court proceedings in three states alleging that technology employed in devices such as the iPhone and Blackberry infringes Kodak’s patents. The technologies at issue in the myriad suits include imaging devices such as digital cameras and video cameras, and related software, as well as printers.
We represented Sigma International (now Baxter Healthcare) in a patent infringement jury trial against CareFusion Corp. in the Southern District of California. The patent at issue related to occlusion sensors for infusion pumps. CareFusion sought $171 million in damages and a permanent injunction. After a two-week trial, the jury returned a complete defense verdict. The verdict received extensive coverage by media outlets such as Bloomberg and IP Law360, and was named one of the top 2012 defense verdicts in California by The Daily Journal.
We are counsel for Amazon.com, Acer, Inc., and Novatel Wireless in Certain Wirless Consumer Electronic Devices and Components Thereof, No. 337-ITC-853, where complainants sought an exclusion order against the Kindle Fire. After a two-week trial, the Administrative Law Judge found no violation of Section 337 (pending).
Our lawyers secured a key victory for Archer Daniels Midland after two weeks of trial before a jury in Syracuse, N.Y. The jury unanimously found ADM's environmentally friendly Caliber brand road-deicing products did not infringe the two asserted patents.
We won a complete victory in the French civil court for a producer of diagnostic instruments for critical care and hemostasis. Our client charged a competitor with infringement of the client’s patents on a method of diagnosing a blood coagulation disorder and with product disparagement through statements the defendant made in advertising. After a trial, the court concluded our client’s patents were valid and were infringed by the defendant, prohibited the defendant from further sales of the test, directed the defendant to make corrective advertising, and as an initial damages ruling, awarded more than €2.3 million to our client. The damages award was based in part on U.S. theories of damages not typically followed in French patent law.
We defended Acer, Silicon Motion, Transcend and Apacer in an ITC investigation filed by SanDisk. The patents at issue describe methods for storing and organizing data in flash memory devices. K&L Gates was lead trial counsel in the non-infringement part of the two-week trial in Washington, D.C. The ITC ruled accused flash memory devices did not infringe the SanDisk patents.
Our lawyers led Microsoft Corporation’s defense in its successful seven-year battle with Apple Computer concerning Microsoft's right to develop and distribute the Windows graphic user interface. This case sharply limited the applicability of “look and feel” concepts in copyright infringement disputes involving software. Microsoft won the case on summary judgment by the trial court and successfully defended that judgment through appeals.
