Mr. Johnson is a trial lawyer focusing on intellectual property and other types of high stakes complex litigation. Mr. Johnson has successfully tried cases to verdict in both state and federal courts, as well as multiple TRO/preliminary injunction hearings. He has also led internal corporate trade secret and copyright infringement investigations.

Intellectual Property Litigation
  • TSMC v. SMIC (Alameda County Superior Court). Led team defending TSMC against counterclaims brought by SMIC in billion dollar trade secret litigation involving microprocessor manufacturing.
  • In the Matter of Certain Amorphous Metal and Products Containing Same (International Trade Commission). Lead counsel with respect to defense of trade secret claims brought by Complainant in ITC against Chinese client. Obtained voluntary dismissal of claims after demonstrating lack of any misappropriation.
  • Intellisoft v. Acer (N.D. CA). Co-lead counsel for defendants in multi-million dollar trade secret litigation case. Took deposition of key liability expert, which led to successful removal to federal court weeks before a state court trial. Federal court granted summary judgment on all claims in favor of client.
  • Bikila v. Vibram USA (Western District of Washington). Lead counsel for defendants in Lanham Act false endorsement and Washington publicity rights case involving claim that defendants improperly used a famous athlete’s name for a running shoe product. Obtained summary judgment on behalf of all defendants after development of extensive expert and survey evidence.
  • Lehigh Valley Technologies et. al. v. Sandoz (District of New Jersey). Co-lead counsel for plaintiffs in Lanham Act false advertising case based on failure to properly identify marketing and sale of unapproved prescription drugs.
  • In the Matter of Certain Potassium Chloride Powder Products (International Trade Commission). Lead counsel for substantive Lanham Act false advertising claims brought by pharmaceutical clients against competitors for mislabeling products. Worked extensively with survey experts to develop survey of pharmacists supporting claims. Successful settlement reached.
  • Angie’s List v. Amazon.com, Inc. (Southern District of Indiana). Co-lead counsel for Amazon in case seeking injunctive relief and monetary damages in case involving trade secret, Computer Fraud and Abuse Act, and Stored Communications Act claims.
  • CD Newco, LLC v.Good Methods Global, Inc. (Middle District of Florida). Co-lead counsel for defendants in claim of trade secret misappropriation and trespass related to commercial software products. Successfully resolved claims without payment of any kind by defendants.
  • RightAnswers v. Amazon Web Services, Inc. (King County Superior Court). Lead counsel for defendant in trade secret claim alleging that defendant misappropriated software and breached license agreement with plaintiff. Brought counterclaims for bad faith assertion of trade secret misappropriation leading to successful settlement.
  • Montrose Environmental v. Zephyr (Eastern District of Washington). Lead counsel for Montrose in trade secret claims against competitor brought under Defend Trade Secret Act. Obtained preliminary and permanent injunctions and favorable settlement prohibiting unfair use and obtaining return of misappropriated trade secrets.
  • Microsoft Corporation v. Tanenbaum et. al. (King County Superior Court). Lead counsel for Microsoft in Lanham Act claim brought against group of defendants.
  • Sambonet Paderno v. Sur La Table (Central District of California. Co-lead counsel for defendant in Lanham Act claim asserting trade dress and false designation of origin claims.
  • Microsoft Corporation v. Google Inc., Dr. Kai-Fu Lee (King County Superior Court). Led team representing Microsoft in litigation against Google and Dr. Lee. Successfully argued motion for Temporary Restraining Order and prevailed in mini-trial obtaining Preliminary Injunction prohibiting Google and Dr. Lee from misappropriating Microsoft trade secrets or otherwise violating Dr. Lee’s non-competition agreement.
  • Placeware v. Higgins et. al. (Santa Clara County Superior Court). Lead trial counsel for Placeware in litigation against several former employees for misappropriation of trade secrets. Obtained permanent injunctive relief as well as other relief against each former employee.
  • Varghese v. Amazon.com, Inc. (King County Superior Court). Lead trial counsel for Amazon in claim alleging misappropriation of trade secrets and conversion of invention. Case resolved four months prior to trial following filing of summary judgment motion.
  • MediaNet, Inc. v. Boxlight Corp. (Southern District of New York). Successful defense and resolution of copyright infringement claims against defendant.
  • Lead trial counsel for current owners of HK Systems/Endura/Irista ERP software in several software copyright infringement suits.
  • Amazon.com, Inc. v. Nimbula (King County Superior Court). Lead trial counsel for Amazon in litigation against start-up cloud computing company comprised primarily of former Amazon employees.
  • Floor Factory, Inc. v. Smooth Corp (San Francisco Superior Court). Successfully resolved cross-claims against plaintiff for trademark infringement and trade secret misappropriation.
  • RealNetworks v. LockStream (King County Superior Court). Successful defense and resolution of start-up company in trade secret misappropriation litigation.
  • Wistron Corporation v. Samsung Electronics Co., Ltd. (Northern District of California). Managed key elements of multi-million dollar patent infringement case involving computer software and hardware related patents.
  • Unigen Pharmaceuticals, Inc. v. Leiner Health Products, LLC. (Western District of Washington). Successfully obtained dismissal of patent infringement and false advertising claims related to nutritional supplements.
  • Wacom Co. Ltd. v. Hanvon Corporation (Western District of Washington). Took lead on key elements of patent infringement case related to drawing tablet technology.
Commercial Litigation
  • City of Seattle v. Professional Basketball Club (Western District of Washington). Represented City of Seattle in specific performance lawsuit seeking to prohibit the Seattle Supersonics NBA basketball team from breaking its lease. Examined several witnesses during trial. Matter settled one hour before issuance of Court’s ruling.
  • Hawks Prairie v. Cabela’s (Western District of Washington). Lead trial counsel in jury trial regarding multi-million dollar dispute involving land valuation and related issues.
  • International Arbitration. Lead trial counsel in international arbitration involving technology license dispute (2015).
  • Bill and Melinda Gates Foundation v. Teachscape (Western District of Washington 2015). Represented Gates Foundation in licensing dispute with grantee Teachscape in dispute over intellectual property rights. Case settled favorably shortly after filing of Complaint.
  • Case Under Seal. Lead defense counsel in data breach class action.
  • Keahole Point Fish LLC v. Skretting Canada, Inc. (Federal District Court of Hawaii 2014). Lead trial counsel representing defendant feed manufacturer in technical dispute regarding fish nutrition, disease and husbandry issues. Filed successful summary judgment motion leading to negotiated resolution of remaining claims.
  • Motricity, Inc. v. Elfman (King County Superior Court). Obtained Dismissal with Prejudice of multiple claims brought against executive by former employer.
  • Microsoft Corporation v. Digeo, Inc. (King County Superior Court). Led team representing Microsoft in multi-million dollar litigation involving complex technology and licensing agreement issues.
