Ms. Hepburn focuses on high stakes intellectual property and commercial litigation in state and federal court. She has successfully tried cases to verdict, and has substantial experience in TRO/preliminary injunction proceedings. She also has significant mediation and arbitration experience.

Intellectual Property Matters
  • Bikila v. Vibram USA, Inc. (Western District of Washington). Defended footwear manufacturer against Lanham Act false endorsement and Washington publicity rights case involving claim that defendants improperly used a famous athlete’s name for a running shoe product. Obtained summary judgment on behalf of all defendants after development of extensive expert and survey evidence.
  • Angie’s List v. Amazon.com, Inc. (Southern District of Indiana). Represented defendant in case seeking injunctive relief and monetary damages based on trade secret, Computer Fraud and Abuse Act, and Stored Communications Act claims.
  • RightAnswers v. Amazon Web Services, Inc. (King County Superior Court). Represented defendant in trade secret litigation involving allegation that defendant misappropriated software and breached license agreement with plaintiff. Brought counterclaims for bad faith assertion of trade secret misappropriation leading to successful settlement.
  • Successfully arbitrated claim for breach of non-solicitation agreement by consultant and related tortious interference with business opportunities claim.
  • Represented software developer in multiple copyright infringement actions.
  • Represented book publisher in copyright infringement lawsuit.
  • Obtained jury verdict in favor of marketing company in case involving breach of non-solicitation agreement and trade secret misappropriation.
  • Represented multiple clients in TRO/preliminary injunction proceedings involving non-competition agreements and trade secret claims.
  • Provided in-house support to gaming company in areas of trademarks, licensing, and copyrights.
Commercial Matters
  • Keahole Point Fish, LLC v. Skretting Canada, Inc. (Federal District Court, Hawaii). Represented defendant feed manufacturer in technical dispute regarding fish nutrition, disease, and husbandry issues. Filed successful summary judgment motion leading to negotiated resolution of remaining claims.
  • Hawks Prairie v. Cabela’s (Western District of Washington). Represented defendant in multi-million dollar dispute involving land valuation and related issues.
  • Defended musician in trial of breach of contract and publishing claims (settled during trial).
  • Defended client against multi-million dollar fraudulent transfer claim involving defenses under Section 548 of the Bankruptcy Code and Section 29(b) of the Securities Exchange Act of 1934.
  • Successfully defended real estate developer in trial of breach of contract claims.
  • Arbitrated multiple breach of contract actions involving vendor disputes on behalf of online retailer.
  • Provided in-house support to travel industry clients in areas of patent litigation, defamation and privacy claims, consumer complaints and class action litigation.
  • Provided in-house support to retail client in areas of commercial disputes, discrimination claims, ADA litigation, and real estate litigation.

Professional Background

Prior to attending law school, Ms. Hepburn worked as a DJ at several radio stations in the Midwest. She was also a DJ on KEXP, 90.3FM, in Seattle. She was a summer associate at Preston Gates & Ellis LLP in 2001.
