The Rapanos and Carabell Rulings: Consequences for Clean Water Act Enforcement, Regulation, and Compliance

Sponsored by the Washington Legal Foundation
18 June 2008
Presenters: Barry M. Hartman

This webinar, sponsored by the Washington Legal Foundation, discussed the recent U.S. Supreme Court decision that addresses the extent to which the federal government may require 'dredge and fill' (wetlands) permits before construction, farming, development or other activity can take place on certain properties. In addition to Mr. Hartman, the webcast included Sue Ellen Wooldridge, Assistant Attorney General for the Department of Justice, and Ann Klee, General Counsel of the Environmental Protection Agency.
Event Highlights:

  • An overview of the U.S. Supreme Court’s ruling and analysis of the multiple Court opinions.
  • An assessment of how Rapanos/Carabell impacts the Justice Department’s enforcement of the CWA.
  • A discussion of how the rulings affect EPA’s regulation of wetlands.
  • Thoughts on how the Court’s decision could be practically applied in clean water-related compliance and litigation.
