Mr. Rappensberg is a lawyer in our Commercial Litigation and Dispute Resolution team. He acts on a wide range of corporate and commercial disputes across various industries and commercial sectors. His practice focuses in particular on litigation involving: breaches of commercial contracts, corporate governance and corporate transactional disputes, breaches of restraint of trade / confidential information clauses, building and construction disputes (including "Security of Payment" claims), consumer law disputes, defamation, equity issues and breaches of fiduciary duties, statutory interpretation, and wills & estates disputes.

Mr. Rappensberg also has extensive experience in defending professional negligence claims, as well as acting in product liability disputes. He has also recently assisted in the preparation of detailed responding submissions to the Royal Commission into Aged Care Quality and Safety.

Mr. Rappensberg regularly advises on risk management issues, including on contractual and statutory compliance and dispute resolution and termination processes. 
 

Complex Litigation:
  • Assisting a major aged care services provider in the preparation of its detailed response to the initial, opening letter from the Royal Commission into Aged Care Quality and Safety, including advising on key issues outlined in the Commission's terms of reference and its initial letter.
  • Defending indemnified law firms (and lawyers) in Victoria and New South Wales in professional negligence claims, including in proceedings in the Supreme Court of Victoria and the County Court of Victoria.
  • Defending total and permanent disability insurance claims (involving physical and/or mental impairment) made by members of a major superannuation fund on behalf of the trustee of that fund.
  • Acting for, and advising, plaintiffs and defendants in a wide range of commercial litigation matters including in proceedings in the Supreme Court of Victoria and the County Court of Victoria.

Prior to joining K&L Gates, Mr Rappensberg advised and assisted in the conduct of litigation involving:
  • A major construction, development, and hospitality company in a breach of contract, estoppel and misrepresentation claim in the Supreme Court of the Northern Territory against an international oil company.
  • A lessor company opposing an application made in the Supreme Court of South Australia by a former tenant company (and its directors) seeking orders setting aside a perfected judgment and a re-trial, including successfully appealing the Full Court of the Supreme Court of South Australia’s judgment in the High Court of Australia.
  • An international law firm in relation to cross-claims brought in the Federal Court of Australia by the former directors of a company in liquidation alleging “knowing involvement” in breaches of the Corporations Act 2001 (Cth) and negligence in relation to certain corporate transactions.
  • An international law firm appealing the District Court of South Australia’s judgment in the Full Court of the Supreme Court of South Australia – a “failure to advise” claim regarding penumbral duties of care in relation to a share acquisition transaction.
  • An Australian law firm in relation to a trial in the Supreme Court of South Australia on a preliminary point, more specifically, the proper interpretation of certain provisions of the amended Retail Leases Act 1995 (SA).
  • A residential property developer company defending various claims brought against it by subcontractors following its head construction contractor becoming insolvent and addressing alleged outstanding payments and bank guarantee issues.
