At the heart of our Social Media Law practice is a keen awareness of the role that social media plays in today’s business development and success. The practice is specifically designed to assist clients in maximizing social media to achieve business goals. At the same time, we provide our clients with critical guidance to ensure their social media uses conform with existing legal precedent, as well as regulations governing the fields of intellectual property, advertising and marketing, employer-employee relations, importing and exporting, corporate governance, and more. We also work closely with clients to craft effective litigation prevention strategies surrounding social media use, and draw upon our world-class litigation talent to vigorously protect business, proprietary, and personal interests if and when the need arises.

What We Do
Over the past several years, we have fielded an increasing number of inquiries regarding the application of current law to social media use, with a particular focus on social media’s impact on business creation, development, regulation, and marketing. Those inquiries have spanned our practice areas, implicating intellectual property, advertising, trade disparagement and defamation, discovery, privacy, employment law, securities law, and more.

Advised fund client on how to create a social media site without becoming an investment adviser, where the site will allow advisers and brokers to meet clients.
Guidance on NLRA/NLRB rules, regulations, and requirements of employers, along with related litigation.
Advised a liquor manufacturer on its social media marketing and trade promotions strategy for compliance with Australian Consumer Law, trade promotion requirements, and Facebook terms of use.
Assisted various clients on using social media “widgets/plug-ins” (e.g., a like button) with understanding impact on their privacy policies and business because of social media developer rules and case law.
