Mr. Cottle is an experienced trial attorney and litigation partner in the firm’s New York and Pittsburgh offices who focuses his practice in a variety of areas, including commercial disputes and the manufacturing and technology industries. Mr. Cottle has extensive trial experience and has successfully argued cutting edge legal issues before various tribunals and courts in hearings and at trial with great success. He represents clients across the country in multiple jurisdictions and in high volume and high-stakes litigation. Along with litigating and arbitrating commercial disputes, consumer product defect claims, including the defense of personal injury/wrongful death actions involving various products, such as motor vehicles, machinery and electrical equipment, and toxic tort claims, including the representation of companies in asbestos, silica, and lead pigmentation matters, Mr. Cottle advises clients in several key areas, including managing risk and developing and implementing company-tailored solutions to complex legal issues that align with the client’s current and long term business objectives.

Mr. Cottle’s litigation and risk management experience extends to the industries of commercial and consumer products, industrial and commercial coatings, metal manufacturing and fabrications, heavy-duty industrial port machinery and off-shore products, energy and technology.

Professional Background

Prior to joining K&L Gates, Mr. Cottle was a litigation partner at a Pittsburgh law firm where he provided strategic, comprehensive and practical advice to clients facing a range of commercial disputes, business torts, zoning and land use issues, consumer litigation, unfair competition and deceptive acts, environmental law, products liability, consumer fraud, warranty and recall matters.

  • Represent major Chinese manufacturer of outdoor living furniture in defective product claim involving significant personal injuries and economic loss, failure to warn and breach of warranty.
  • Represent Chinese manufacturer of heavy-duty industrial port machinery and off-shore products in matters related to product safety, product testing and training, labeling and warnings, and risk management.
  • Represent software developer bringing claims against its competitor for deceptive business practices, tortious interference with business and contractual relations, and making false and misleading statements to deceive customers.
  • Litigation consultant to Montreal-based manufacturer of industrial equipment on risk management and U.S. based litigation strategy for potential mass tort claims involving asbestos exposures.
  • Litigation consultant to dealer-broker regarding commercial disputes, breach of fiduciary duties, fraud and misrepresentation.
  • Represented German business owner in a commercial dispute alleging breach of express contract and implied warranties, fraud/misrepresentation and violation of the Magnuson-Moss Warranty Act because a customized formula boat purchased from a U.S. based boat manufacturer lacked CE certification and could not be operated in the European Union.
  • Litigation consultant to global cable manufacturer to the energy sector in products liability claim involving failed component resulting in alleged catastrophic personal injuries and significant economic damages.
  • Represented major pet food manufacturer with regard to claimed exposures to glyphosate, deceptive and misleading labeling, fraud and misrepresentation.
  • Represented Japanese notebook computer manufacturer in regard to claimed product defect involving alleged defective lithium batteries overheating causing property damage and burns to end users.

  • Global industrial manufacturer found 30% liable after a 2-week trial in wrongful death action involving asbestos exposure at several steel and foundry sites located in Western Pennsylvania.
