Feroze Abbas (Partner - qualified in 2003) advises on all aspects of planning and environmental law, local government vires and housing regulation. Feroze acts for and advises public bodies, investors and funds in delivering varying types and mixes of regeneration and development schemes.

Specific relevant experience includes providing planning advice and drafting of complex development, S106, highways and other statutory agreements for public authorities. Feroze also advises public authorities on vires powers, regulatory issues and transactional structuring.

Feroze has over 7 years experience working in-house with public authorities, including managing an in-house legal team. Feroze is uniquely placed to understand the needs and complexities associated with working with and for public sector organisations.

In his current role at K&L Gates he continues to have a close relationship with public authority organisations providing external planning legal support and being the principal K&L Gates point of contact for work with the London Borough of Hounslow. Other public authority clients Feroze advises regularly include London Borough of Barking and Dagenham, Rushmoor Borough Council, Telford & Wrekin Council and TfL.

Feroze is responsible for drafting complex bespoke development agreements, s106 agreements for key regeneration sites and advising on planning, highways, transport, compulsory purchase and environmental aspects of proposed urban regeneration projects. Feroze liaises directly with internal planning, housing and regeneration officers and conducts negotiations with developers on behalf of public authority organisations. He also advises on Local Government and Public Authority vires and regulatory issues (including Housing regulation) and provides procedural advice as and when required.
Feroze has assisted in delivering varying types of development including commercial, office, residential and mixed use schemes.

Feroze also has particular experience in PPP/local authorities and RSL Housing delivery models.

Professional Background

Feroze joined the firm in 2008. He was previously a planning, environment and litigation solicitor at Cambridge City Council dealing with various regeneration and planning issues including delivery of major regeneration sites, Section 106 Agreements, licensing and a variety of contentious matters. Prior to that role Feroze was Head of Litigation at Dover District Council.

TfL Heygate Redevelopment

  • Advising and securing development consent for the proposed development on the Heygate Estate. This is a £1.5 billion value development in Elephant and Castle in London. The development will consist of a vibrant mix of homes, shops, business and community facilities, set in a network of open spaces and a new park. Representing TfL in negotiations and drafting of a complex infrastructure agreement securing mitigation of development impact (in particular in respect of transport network impact securing and guaranteeing circa £26million value of transport mitigation works, including enabling works to the Elephant Castle underground station and surrounding bus transport network). The completion of such agreement being a pre-requisite to the granting of the development consent.

Redevelopment of former Industrial and Petrol Filling Stations sites for Supermarket use

  • Advising Institutional Client on all environmental and planning issues in relation to remediation and planning issues for redevelopment of former petrol filling station sites for supermarket use.
  • Advising on planning strategy and negotiation with planning authority.
  • Negotiating and drafting planning and environmental elements of development agreement and deal documentation.

Development and Regulatory Advice for Local Authorities

  • Advising on and securing regeneration of multiple key sites in Hounslow including, Sky Headquarters, Brentford Riverside Redevelopment, Brentford Football Club.
  • Recently advised Rushmoor BC on the £100 million regeneration in Farnborough with St Mowden and on Aldershot with Citygrove.
  • Advised Rushmoor Borough Council on the £70m redevelopment of central Aldershot and the sale of that investment.
  • Advised Braintree Borough Council on the Town Hall Regeneration.
  • In 2012 advised Long Harbour Capital LLP and Hutchison Whampoa Limited on the regeneration of William Street Quarter and Eastern End Thames View to deliver 477 new homes to London Borough of Barking and Dagenham at nil public cost.
  • In 2012 he advised Gatehouse Bank on a major Sharia Compliant Investment project in Leeds.
  • In 2013 advised London Borough of Barking & Dagenham on delivery of 250 new homes at Abbey Road, Barking.
  • Advising on Housing regulation, vires and development aspects on the two largest social housing PFI/PPP projects to reach financial close in the UK in 2013, both of which were financed via capital markets fund-raising through the issue of project-specific listed bonds. Our clients on these projects were:
    • Sustainable Communities for Leeds, the preferred bidder and borrower on the £180M Leeds Social Housing (see Matter 1) - this was financed using a monoline 'wrapped' bond, the first time such a financing structure has been utilised on a PFI/PPP project since 2008.
    • FHW Capital, the investment adviser which structured the £82M Pendleton Salford Social Housing (see Matter 2) - this was financed using an unwrapped, two-tranche bond structure (with a subordinate tranche of notes providing credit enhancement for the senior notes without the requirement for a monoline wrap). This was the first time this type of structure has been utilised to secure finance for a social housing PFI/PPP project.
