K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. When appropriate, practice group lawyers team with lawyers in related practice areas, including government enforcement, policy and regulatory, IP, M&A, and construction and engineering, among others.

Bid Protests
Represented one of the country’s major furniture manufacturers at the U/S Court of Federal Claims in protesting the State Department’s government-wide award of a contract to supply residential furniture for families abroad.
Successfully defended our client's award of the Defense Logistics Agency’s contract, which provided world-wide command and control services. We also rebutted the protester’s assertions that our client had falsely represented the availability and commitment of proposed personnel and convinced the DLA and the GAO to eliminate the protester from the competition due to its own misrepresentations.
Claims and Disputes
Prepared and litigated (in federal district court) a substantial (more than $100 million) delay/disruption claim by a major Department of Defense systems subcontractor against a prime contractor managing a missile program for the U.S. Air Force.
Prepared claims to the U.S. Army Corps of Engineers for a contract involving the design and construction of a tank artillery range by the Corps for the Kuwaiti Defense Force and related ADR proceedings.
Prepared claims to the U.S. Army Corps of Engineers for a design/build contract involving the Corps’ construction of a military storage base and subsequent litigation at the COFC.
Prepared a number of claims on behalf of a major aerospace company arising out of the company’s performance of a contract for an air command and control system; the claims included requests for equitable adjustments for out-of-scope effort, failure to provide customer-furnished equipment and information, and delay.
Developed and implemented a client’s strategy over several months regarding its claim that its joint venture partner had breached its obligations, leading to our client’s declaration of breach and subsequent successful defense of its cessation of work.
Prepared and successfully litigated claims before the Armed Services Board of Contract Appeals demonstrating that the Army had provided a defective data package for its ARC-115 radios.
Commercial Item and GSA Schedule Contracting
Assisted client in formulating and implementing a plan to convince the Government to designate the client’s products (aircraft generator and auxiliary equipment) as commercial items under FAR Part 12.
Represented several clients, including one of the larger information technology servicers and integrators, in internal investigations and disclosures to the Inspector General for the General Services Administration (GSA) regarding non-compliances with most favored customer and price reduction obligations under Federal Supply Schedule (FSS) contracts. In one representation, we worked closely with one of the largest forensic accounting experts, analyzing thousands of transactions to develop a proposed restitution that the Agency accepted without auditing or adjustment. The Agency provided us with a formal “close out” letter without pursuing any action against our client.
