K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. When appropriate, practice group lawyers team with lawyers in related practice areas, including government enforcement, policy and regulatory, IP, M&A, and construction and engineering, among others.

Commercial Item and GSA Schedule Contracting
We have assisted a significant number of the leading technology companies and Fortune 100 companies in protecting their intellectual property rights, including rights in subject inventions, patents, data, and software.
Contract Formation and Negotiation Issues
Represented various small businesses in challenging agency and contracting officer responsibility determinations, affirmative and negative, working with the Small Business Administration and agency small business advocates when necessary.
Assisted large aerospace company in securing Other Transaction (“OT”) funding status for dual-use technology it was developing.
Assisted several clients in fighting restrictive specifications that, left in place, would have prevented them from competing to provide the products and services sought by the Government; conversely, supported agencies on various occasions in resisting attempts to reverse sole source agency determinations.
Advised numerous clients regarding Government and prime contractor attempts to include non-mandatory clauses in their contracts and subcontracts.
Contract Pricing
Represented manufacturer of electronic countermeasure devices in resolution of charges that it had mischarged bid and proposal costs as independent R&D.
Worked with company accountants to structure cost segregation systems to prevent mischarging of such costs as lobbying costs, entertainment costs and other unallowable costs.
Represented numerous clients in resolving Government assertions that they had provided inaccurate, incomplete or non-current cost or pricing data (“defective pricing”).
Debarment/Suspension
Successfully represented a Fortune 200 technology contractor in present responsibility proceedings before the Army and GSA debarment/suspension authorities relating to a False Claims Act (“FCA”) settlement.
