K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. When appropriate, practice group lawyers team with lawyers in related practice areas, including government enforcement, policy and regulatory, IP, M&A, and construction and engineering, among others.

Assisted a major DOD defense/aerospace contractor in its $1 billion acquisition of a major military vehicle supplier.
Ethics/Compliance/Internal Investigations/Mandatory Disclosure
Conducted a comprehensive government contracts compliance review for a Fortune 300 company with extensive federal/state contracts arrayed across four business units. The review examined policies/procedures/IT system capabilities and focused on matters such as code of ethics and ethics training; business conduct policies; security; subcontracting; pricing; IP rights; cost accounting standards; and others. Assisted in implementing recommendations, including the development of new policies/procedures.
Developed and implemented a comprehensive government contracts compliance training program for a Fortune 200 contractor with global operations, including R&D as well as products and services. The program involved topics such as ethics, regulatory obligations, proper contract structure, pricing and performance, as well as detailed guidance on “red flag” and “high risk” public sector issues. The program has been presented (in both in-person and webinar format) to hundreds of employees.
Served as company-wide outside ethics counsel for several years to one of the founders of the Defense Industry Initiative; investigated, analyzed and reported upon each suspected or reported instance of improper or possibly illegal conduct; conducted all witness interviews under the attorney-client privilege, reported to management and formed strategies for disclosure, negotiated with Government representatives and formulated and implemented remedial actions; led action to revise company policies and procedures when appropriate and conducted company-wide training.
For a Fortune 10 company, prepared a 50-state guide to compliance with procurement ethics laws.
Directed the formation of compliance programs for several companies, including a manufacturer of commercial launch vehicles, an information technology systems integration company, a major construction company, and others.
Internal investigation and disclosure concerning pricing irregularities for a major manufacturer on a series of GSA contracts (resulting in a Civil False Claims Act settlement for less than 3 percent of government demand).
Internal investigation and defense of DOD/USPS software security and services contractor in parallel criminal and civil proceedings in the Northern District of California (resulting in criminal declinations and a settlement of Civil False Claims Act allegations).
Conducted an internal investigation for one of the largest defense and systems integration contractors into allegations that one of its units had misrepresented the commercial availability of certain software packages it had included in a major proposal.
Internal investigation and criminal defense of a major defense/aerospace contractor in a proceeding in the Eastern District of Virginia alleging conversion of classified DOD budgetary documentation (Operation Uncover).
