K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. Internal investigation and mandatory disclosure concerning cost- and time-charging issues in a technology contract with a major intelligence agency (resulting in no action being taken against the contractor).
Internal investigation and mandatory disclosure concerning socioeconomic noncompliance issues by a major DOD software provider (resulting in no action being taken against the company).

Export Control
Represented a number of companies in assessing their rights and obligations with regard to the proper export of items and technology that might be subject to the ITAR (International Traffic in Arms Regulation) coverage by the State Department or EAR (Export Arms Regulation) coverage by the Commerce Department. We have also handled Customs Department issues, submission of Commodities Jurisdiction Requests, and Voluntary Disclosures of past non-compliances.

United States ex rel. Folliard v. Hewlett-Packard Co., 272 F.R.D. 31 (D.D.C. 2011). Successful motion to dismiss Civil False Claims Act whistleblower complaint alleging fraud and violations of the Trade Agreements Act.
United States ex rel. Folliard v. Synnex Corp., 2011 WL 2836372 (D.D.C. 2011) (successful motion to dismiss Civil False Claims Act case against Fortune 10 IT contractor).
United States ex rel. Crennen v. Dell Marketing L.P., 711 F.Supp.2d 157 (D. Mass. Apr 27, 2010). Successful motion to dismiss Civil False Claims Act whistleblower complaint in which we represented Hewlett-Packard but argued the motion on behalf of all industry defendants.
United States ex rel. Rille v. EMC Corp., Case No. 1:09-cv-00628 (E.D. Va. 2009) (co-counsel in successful motion to dismiss Civil False Claims Act complaint against Fortune 200 IT contractor).
