K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. When appropriate, practice group lawyers team with lawyers in related practice areas, including government enforcement, policy and regulatory, IP, M&A, and construction and engineering, among others.

International Contracts
Represented Fortune 100 company in negotiations with an Indian company and the Indian Government following the client’s discontinuation of work to construct the country’s cellular phone system; central issues involved technical performance disputes, failure to make payment, export control issues, disposition of work in progress and Indian banking issues governing payment to foreign entities.
Served as counsel to the American company that acted as lead contractor in forming an eight-nation consortium to develop the European version of an electronic suite of cockpit equipment for use in European fighter aircraft.
For a Fortune 10 company, provided a comprehensive guide on domestic content requirements in the public procurement laws/regulations of approximately a dozen Pacific Rim nations, including China, Taiwan, Australia, New Zealand, Singapore, and Malaysia.
Prepared and successfully pursued substantial claims for differing site conditions in connection with the performance of a significant earth moving contract for South Africa’s national railroad system.
R&D/Technical Data/Intellectual Property
Assisted a Fortune 250 company in negotiating numerous Department of Energy R&D financial assistance awards including obtaining advance patent rights in the technology to be developed, as well as several technology investment agreements and other transactions with the Department of Defense for development of certain new defense technologies, retaining specialized IP rights.
Advised and represented one of the premier U.S. research laboratories in disputes relating to its inadvertent failure to use restrictive legends relative to technical data that it had developed.
Counseled many clients regarding protection of intellectual property as “limited rights” data under government contracts and allocation of rights between prime contractors and subcontractors.
Assisted a Fortune 250 company in negotiating a variety of OTs with federal agencies for research into specialized defense and energy-related technologies, retaining specialized IP rights, and negotiating waiver of certain government patent rights and manufacturing obligations.
Assisted a joint venture of two global companies in negotiating an OT with the Defense Advanced Research Projects Agency for certain dual-use technologies, involving beneficial and specially-tailored IP rights.
