K&L Gates’ government contracts and procurement policy practice spans the globe, with a core of practitioners located throughout the United States and in Europe.

The practice group assists public sector procurement clients worldwide in regulatory, transactional, and litigation matters. When appropriate, practice group lawyers team with lawyers in related practice areas, including government enforcement, policy and regulatory, IP, M&A, and construction and engineering, among others.

Socioeconomic Requirements
Designed and implemented a comprehensive affirmative action compliance program for one of the largest insurance companies in the world after it acquired a company that performed hundreds of commercial and Government contracts.

State & Local Contracts
Successfully defended a major IT services contractor in proceedings under the California False Claims Act brought by former county government CIO.
Assisted numerous protestors in state bid protest proceedings in various jurisdictions.
Assisted numerous contractors with a variety of state schedule contract negotiation and performance issues.
Served as lead negotiator, counsel, and project team leader for a sanitary district in the Midwest with regard to the construction of a wastewater treatment plant and storm/sewer separation project, including resolution of claims brought by contractors and subcontractors.
Terminations
Successfully represented various clients in converting terminations for default into terminations for convenience. Our representation included preparation of claims for out of scope work that avoided application of the loss adjustment formula.
Construction
Prepared or defended more than one hundred claims under federal Government contracts and cooperative agreements, representing contractors and subcontractors, and also owners.
Represented a major construction company in multi-million dollar dispute with federal agencies under a fixed price privatization contract to design-build a federal agency’s modernized high-tech campus. The issues included differing site conditions, defective specifications, interagency lease arrangements, excessive inspections, constructive changes, suspension and possible termination of work by the contractors and threatened termination for default by the Government.
Represented a major construction company against allegations and the ensuing lengthy investigation brought by the Department of Justice under the civil False Claims Act, which involved allegations of improper invoicing under Government contracts accounting procedures.
