Jacquelyn (“Jackie”) Celender is a partner in the firm’s Pittsburgh office, who concentrates her practice on complex commercial litigation, international arbitration, class action defense, and insurance coverage. Ms. Celender has significant experience managing complex litigations and arbitrations, leading extensive fact investigations, drafting complex written submissions, and handling complicated e-Discovery matters. Ms. Celender’s first and second-chair trial-related experience includes conducting fact and expert witness examinations, taking and defending depositions, preparing witnesses for examinations at trial and deposition, and motions practice. Ms. Celender also advises clients on external risk management and resolving disputes through negotiated settlements, mediations, arbitrations or trials.

Ms. Celender’s complex commercial litigation experience extends to the areas of international arbitration, and class action defense, commercial contract, warranty, indemnification, product liability, and personal injury disputes in a number of state and federal courts, for clients in a variety of industries and sectors, including industrial and engineered metals manufacturing, specialty chemical, oil and gas and energy.

In the insurance coverage area, Ms. Celender represents corporate policyholders seeking coverage under many different types of insurance policies, including commercial general liability policies, “Bermuda Form” excess liability policies, professional liability policies and property policies. Ms. Celender has been second chair in multiple international arbitrations involving significant insurance assets and also counsels clients regarding their insurance coverage programs outside of litigation.

Complex Commercial Disputes
  • Defend major aerospace supplier in three separate ICC arbitrations in London, Geneva and Paris filed by an original equipment aircraft manufacturer alleging material defects in certain products.
  • Defend major chemical company in connection with civil liability and damage claims arising from a series of chemical fires at a Texas facility in the wake of Hurricane Harvey in September 2017, including the defense in federal court of a putative class action involving upwards of 30,000 individuals who allege a variety of personal and property injuries and another federal court case of combined individual actions involving 200+ plaintiffs, who were allegedly injured and/or suffered property damage during the fires.
  • Represent a major aluminum company in an ICC arbitration brought by a Dutch mining company over claims related to the development of a bauxite mine in Suriname.
  • Represent energy services company in products liability lawsuit arising out of allegedly defective product.
  • Represent midstream pipeline company in mechanic’s lien and payment dispute with subcontractor.
  • Represent hospital in real estate dispute.
  • Counsel to engineered metals manufacturer and aluminum manufacturer in commercial contract, product liability and personal injury cases in a variety of U.S. jurisdictions and in domestic and international disputes.
  • Represent forging company in a multi-jurisdiction breach of contract and warranty dispute with customer.
  • Represent developer of the Phoenix Sky Train project at the Phoenix International Airport in dispute against engineers and contractors.
Insurance Coverage
  • Represent policyholder in multi-jurisdiction dispute regarding insurance coverage for asbestos product liabilities.
  • Represent a major energy services company in a London-based arbitration against an insurer that refused to indemnify the company for its portion of a $1 billion settlement entered into to resolve lawsuits arising out of an explosion and fire that occurred onboard the Deepwater Horizon drilling rig in 2010.
  • Advise U.S.-based oil and gas company on insurance coverage issues arising out of an onshore pipeline spill in Canada.
  • Counsel to client involved in insurance coverage dispute stemming from modular construction project.
  • Counsel to policyholder in tortious interference case against the Berkshire Hathaway entities, National Indemnity Company and Resolute Management, Inc., as well as in related arbitrations against Underwriters at Lloyd’s and AIG Insurers.
  • Represent specialty chemicals company in obtaining insurance coverage for asbestos and environmental liabilities.
