Ms. Landry is a trial lawyer who represents and counsels clients on business matters involving breach of contract, fraud, deceptive trade practices, unfair competition, misappropriation and theft of trade secrets, breach of fiduciary duty, negligence, securities fraud and temporary and permanent injuctive relief. Ms. Landry has experience in federal and state courts in bench and jury trials and in arbitration proceedings. Ms. Landry also has experience in advising and litigating claims for clients in the area of labor and employment law, including matters involving issues under Title VII, the Americans with Disabilities Act, and the Fair Labor Standards Act.

Ms. Landry has represented clients across a variety of industries, including health care, real estate, retail, sales, telecommunications, and manufacturing.

Trial Matters

  • Obtained a directed verdict in a jury trial in Dallas County in an employment case on behalf of a major hospital. Directed verdict granted after 3-days of testimony and resulted in dismissal of Plaintiff’s entire case.
  • In a bench trial in the U.S. District Court for the Northern District of Texas, obtained complete judgment in favor of mother seeking the return of her minor child in an international child abduction case brought pursuant to the Hague Convention on the Civil Aspects of International Child Abduction. 
  • Jury trial in Tarrant County in complex case where plaintiff sought reformation of a real estate contract due to alleged mutual and unilateral mistake.
  • Defense of large health care client in complex arbitration proceeding involving claims for late payment of medical claims. Case was tried to 3-member panel of arbitrators.
  • Assisted in obtaining favorable arbitration award on behalf of client, The Susan G. Komen Breast Cancer Foundation, in a contract dispute. The award denied all of plaintiff's claims against Komen and granted Komen's counterclaims against plaintiff.
  • Successfully prevented entry of temporary injunction after 3-day evidentiary hearing on behalf of information technology client in a case involving alleged breach of no-hire and non-compete provisions.
  • Assisted in obtaining injunctive relief on behalf of health care client to protect confidential information and trade secrets through enforcement of non-competition and non-solicitation clauses against former partners/doctors.
  • Assisted in obtaining TRO and temporary injunction on behalf of client enjoining a bank from honoring a letter of credit in case where presentation documents were false.

Litigation Results
  • Successfully obtained complete Summary Judgment in favor of large corporate client in an Americans with Disabilities Act case in the U.S. District Court for the Northern District of Texas. All of Plaintiff’s claims were dismissed with prejudice. Hartup v. Trane, 2009 WL 2776386 (N.D. Tex. Aug. 31, 2009).
  • Successfully obtained complete Summary Judgment in favor of nationwide retail client in a case involving claims of religious discrimination/retaliation under Title VII, brought in the U.S. District Court for the Southern District of Texas. All of Plaintiff’s claims were dismissed with prejudice.
  • Representation of large corporate client in FLSA wage and hour collective action involving over 1,300 plaintiffs in 5 different states. Case settled on favorable terms after filing motion for summary judgment on client’s behalf.
  • Successful defense of not-for-profit hospital in case brought by former employee involving claims of gender discrimination and retaliation. Resulted in a voluntary dismissal of claims by plaintiff, without a settlement.
  • Successful defense of large corporate client in a case involving claims of sex and pregnancy discrimination under Title VII, brought in the U.S. District Court for the Northern District of Texas. Case settled on favorable terms after filing motion for summary judgment on client’s behalf.
  • Assisted in successfully defending national law firm in complex securities fraud case brought by an Indian tribe.
  • Assisted in successfully defending complex trade secret misappropriation case on behalf of privately owned sales organization.
  • In defending a national commercial aggregates company, obtained summary judgment in an arbitration proceeding based on the principle that a seven figure liquidated damages clause sought to be enforced by plaintiffs was an impermissible penalty. The arbitration panel consisted of three retired Dallas County Judges and their unanimous ruling eliminated all of plaintiffs' claims 10 days prior to the scheduled hearing.
  • Assisted in successfully defending national real estate company in suit alleging fraud in a real estate transaction, DTPA violations, misrepresentations, and breach of fiduciary duty.
  • Assisted in successfully defending large home-builder and real estate developer in suit alleging breach of contract. Obtained non-suit from plaintiff.
  • Assisted in obtaining favorable outcome for retail client, including TRO, allowing the client to recover substantial monies owed to it by a customer threatening to flee the country without paying.
