John M. Farrell

John M. Farrell is a Labor and Employment associate in the Dallas office.

Mr. Farrell has assisted employers in a variety of labor and employment matters including:

• Defending clients during civil trials involving Title VII, § 1981, ADEA, ADA, FLSA, and WARN claims and assisting clients in enforcing non-compete provisions.
• Successfully defending clients against Unfair Labor Practice charges before regional offices of the National Labor Relations Board.
• Preparing for labor arbitrations and drafting post-arbitration hearing briefs, resulting in favorable awards in arbitration proceedings involving a variety of issues, including, for example, contract interpretation and the binding effect of past practices.
• Providing advice and counsel to employers concerning both traditional labor and employment issues, including strategies for establishing and maintaining union-free operations. responding to grievances, minimizing risks of litigation, establishing lawful employment policies, drafting enforceable employment agreements and complying with the WARN Act.

• Conducting effective reductions-in-force;
• Minimizing litigation risks inherent during reductions-in-force;
• Drafting separation and release agreements compliant with OWBPA;
• Avoiding liability and complying with the WARN Act; and
• Advising employers regarding FLSA compliance, including minimum wage and overtime obligations, determining "hours worked," available exemptions, and obligations under various compensation schemes.
