Ms. Smith is an experienced restructuring and insolvency lawyer. She has advised clients on receiverships, workouts, liquidation, voluntary administrations, schemes of arrangement, securities enforcement, enforcing the rights of secured creditors, insolvency litigation and dispute resolution (including investigations and preference recoveries), and debt recovery and enforcement.

Ms. Smith has also worked with clients on insolvency risk management and minimization.

Professional Background

Prior to joining K&L Gates, Ms. Smith worked at the Australian Taxation Office in Strategic Recovery. Ms. Smith also spent two years as Principal Advisor, National Collections Enforcement for Inland Revenue in Wellington where she led the response to the Insolvency Practitioners Bill governing the regulation of insolvency practitioners in New Zealand.

  • Instructing Counsel in relation to examinations of directors and other officers in the Supreme Court of NSW and Federal Court of Australia, including successfully defending applications to set aside examination summonses.

  • Handling numerous claims on behalf of liquidators under the voidable preference regime.
  • Drafting security and loan documentation for financiers and ensuring that the securities are registered on the Personal Properties Securities Register.
