Kimberly Frank is counsel in the firm’s Washington, D.C. office, and is a member of the power practice group. Kimberly represents clients in a broad array of electric utility regulatory matters before the Federal Energy Regulatory Commission (FERC) and state regulatory agencies and in appeals of these agencies’ decisions.

Kimberly’s work includes representing clients in administrative litigation and settlements, rulemaking proceedings and technical conferences, and enforcement matters at FERC. A substantial part of her practice focuses on the design of regional wholesale markets and the complex market rules affecting price, competition and reliability. She has particular experience with the energy, capacity, and ancillary services markets administered by the eastern regional transmission organizations. She also advises clients regarding FERC’s regulation of transmission service and rates and tariff provisions that specify the regional allocation of transmission costs.

Kimberly counsels clients developing renewable energy facilities, regulated by FERC on PURPA, PUHCA and FPA compliance. She assists clients with interconnections to transmission systems and with regulatory compliance matters related to federal- and state-regulated electric power transactions.

Professional Background

Prior to joining the firm, Ms. Frank served as a partner at an American law firm in Washington, D.C. where she focused her practice on representing clients in electric regulatory proceedings before FERC and state utility commissions. Some matters included transmission rates, terms of service, cost allocation, and protocols; mergers; power supply contracts; integrated resource planning; and compliance. Additionally, Ms. Frank represented corporate clients in renewable credit purchases, and development and interconnection of on-site generation, and more.
