Ms. Maxwell has more than 15 years' experience in commercial and property law. She has worked with liquidators, insurers, developers, shopping centre owners, financiers, property trusts, and body corporate managers.

Ms. Maxwell has practical experience dealing with a wide variety of commercial legal transactions. She has a particular interest in distressed asset sales, development of strata titled residential and commercial community titles schemes, commercial and retail leasing, commercial/industrial development projects and management rights.

Ms. Maxwell's practice also includes the sale and acquisition of businesses, including franchised and other collateral arrangements.

Professional Background

Since 2008 Ms. Maxwell has worked as a senior associate in Brisbane. Prior to her appointment as senior associate, Ms. Maxwell gained valuable experience in her roles as property and commercial lawyer and as a precedents manager and compliance lawyer.

Additional Information

Ms. Maxwell has authored "First Letters Package", "Interactive Protocol Checklist", "Last Check Documents" and other publications (co-author) to assist the legal profession with claim prevention in conveyancing and property matters.

She also co-authors and reviews the College of Law's Practice Paper on the Sale and Purchase of Commercial Land in Queensland.

Ms. Maxwell has authored numerous client legal updates, including outlining the practical implications for real estate transactions as a result of inception of the Property Occupations Act 2014.
  • Acting for liquidators receivers and financiers in distressed asset sales in Queensland, including drafting freehold and leasehold land sale contracts to accommodate consideration of a diverse range of related personal property such as development approvals, corporate title structures and primary production crops subject to licensed plant breeder's agency arrangements.
  • Management of sales and registration of titles in various off the plan community titles scheme developments in Queensland. Recent projects include an apartment building comprising 118 strata titled residential units; 70 lot residential use apartments - volumetric and strata titled; and a bus depot with attached commercial strata units.
  • Acting for the seller of a multi-faceted development opportunity combining multi-unit apartment and retail development site, volumetric existing retail shopping centre, existing residential apartment and management rights business.
  • Drafting off the plan contracts and proposed community titles scheme documents under “staged” arrangements in Queensland including multi staged mature living and residential apartment resort style schemes, commercial premises within multi unit developments and associated building management statements and commercial agreements for lease.
  • Acting for property developers and purchasers of management rights businesses, including transactions where the community titles scheme and management rights pre-existed and also where schemes have yet to be established in Queensland.
  • Acting for sellers and buyers in the sale of commercial land in Queensland often subject to an option to purchase, due diligence enquiries, and development approval conditions.
  • Advising on various business sales and acquisitions in Queensland and Victoria in Australia including:
    • acting in both sales and purchases of a café chain of franchised businesses
    • acting for a large national Australian food distribution company in the acquisition and sale of licensed bottle shop businesses
    • acting for a property developer in the sale of two inter-related sales of management rights businesses, one where the community titles scheme and management rights pre-existed, and one where we had to first establish the scheme
    • assisted in drafting the contract and in due diligence preparation for a large transaction involving the sale of multiple hotels and detached bottleshops.
