Mr. Prieto has 12 years of experience which extends across the resources, energy and infrastructure industries. He advises on energy and infrastructure development projects. He specialises in the provision of strategic and commercial legal advice throughout the energy / infrastructure asset lifecycle: from project acquisition, development (including offtake contracting and grid connection), financing, construction, operation, joint ventures and divestment.

He has acted for clients in both Australia and Latin America, including developers, sponsors, lenders, contractors and government agencies on a wide variety of energy and infrastructure projects including wind farms, solar projects, hydropower and pumped hydro projects, thermal projects, highways, transmission facilities and mining projects.

Mr. Prieto has expertise in drafting and negotiating project agreements, EPC, O&M, PPA, offtake, connection and access agreements. He also has experience leading due diligences on major projects.

Professional Background

Prior to joining K&L Gates, Mr. Prieto was a senior associate at a top tier international firm in Sydney. Prior to that he held a senior legal counsel role for a listed Chilean infrastructure company, and senior practitioner roles within a number of leading international and local law firms, both in Australia and Chile. He also undertook a secondment in the legal department of Codelco's headquarters in Chile.

Experience prior to joining K&L Gates:
  • Advising on procurement process of Snowy 2.0 pump hydroelectric scheme in Australia (AUD4.5 billion approx.), drafting EPC, interface and approvals commitment agreements, and other related agreements.
  • Supporting Besalco Holding's energy division in the development, financing, construction and operation of energy generation and transmission facilities in Chile
  • Advising Barrick on the international bid and sale of 50% of Compañía Minera Zaldívar in Chile. Legal due diligence and regulatory advice on energy assets.
  • Acting for the lenders (International Finance Corporation, Overseas Private Investment Corporation and a consortium of foreign and local banks) as the head of legal/environmental/social due diligence on project financing of Luz del Norte solar farm; and project financing of Alto Maipo hydropower project.
  • Advising Pacific Hydro on the development, project financing, contractual and corporate issues related to its energy projects in Chile.
  • Advising Mainstream Renewable Power on the development, project financing and construction of solar and wind farm projects in Chile
  • Supporting Besalco Holding on its infrastructure and PPP projects in Chile, including project documents drafting and negotiation, project financing, regulatory issues and interface with the relevant authorities, corporate advisory and litigation.
  • Supporting Codelco on its mining operations in Chile, advising on commercial and contractual issues.
