Mr. Feetham's practice focuses on the areas of technology, telecommunications and outsourcing. He has more than 20 years experience in these sectors.

Mr. Feetham has extensive experience advising on systems integration agreements, outsourcing transactions, cloud computing contracts, smart grids, telecommunications regulation and competition issues, network rollout agreements, wireless networks and services, broadband services (including Fibre, ADSL, Cable, 3G and 4G wireless), content licensing, and vendor contracting with NBN Co.

Mr. Feetham advises leading technology suppliers, including international and domestic telecommunications companies and international IT companies as well technology users including stock exchanges, financial institutions and government agencies.

Professional Background

Prior to joining K&L Gates, Mr. Feetham was a partner at a national Australian law firm between 1996 and 2012.

  • Advising Oracle on large SI contracts (billing system and CRM) involving customers such as AGL, Alinta, Aurora, Delta, EnergyAustralia, Envestra, Integral, Hunter Water, Hong Kong Light and Power, Transurban, TRUenergy, TrustPower, United Energy, and Yarra Valley Water.
  • Advising Oracle on implementing a new system to run and manage the Qantas Frequent Flyer system.
  • Advising ASX on multiple mission critical contracts for the installation of new trading platforms for the securities and futures markets, risk management systems, market surveillance systems and related market management systems and mission critical support and service level arrangements for those systems.
  • Advising Silver Spring Networks on major smart grid contracts in Western Australia, Victoria, New South Wales and New Zealand.
  • Advising the New South Wales Government on a systems integration contract involving the installation of a new computer system to manage public housing in New South Wales.
  • Advising the State Library of New South Wales on a systems integration contract for a new system to make its archive available online.
  • Advising Vodafone Hutchinson Australia on the acquisition of new billing systems and other technology required to operate its network.
  • Advising Vodafone Hutchinson Australia on the acquisition of content from more than 20 companies, including the BBC, eBay, E! Entertainment, Facebook, Fairfax, FoxSports, MySpace, MTV, Google, Ninemsn, Sky News, Yahoo, and YouTube.
  • Advising a Dutch company on the implementation of a large smart card project in Australia with Telstra.
  • Advising Endeavour Energy on outsourcing arrangements with Optus and Logica, and several major IT procurements.
  • Advising Dimension Data on a major hardware and service supply contract with NBN Co.

Telecommunications

  • An international consortium bid for the second Australian carrier licence.
  • Advising Vodafone Hutchinson Australia on customer terms and conditions, customer contracts, customer tariffs, global customer agreements, backhaul agreements, regulatory requirements, premium mobile services, wholesale agreements, dealer agreements, resale, spam and "do not call" obligations, and privacy obligations.
  • Advising Amcom on contracts with major customers, fibre network rollouts, cloud computing services and major customer tenders.
  • Advising Fujitsu on its contract to rollout the NBN in greenfields housing estates.
  • Advising energy companies on granting NBN Co access to their power pole networks.
  • Advising Landcom on several contracts to build and operate FTTH networks in New South Wales.
  • Advising British Telecom on various telecommunications projects and outsourcing projects in Australia including the roll out of a private network in New South Wales.
  • Advising Lucent in relation to a large scale project to build a new CDMA mobile network in Australia.
  • Advising TransGrid on a contract with SP Telecom to provide SPT with access to TransGrid's fibre network.
  • Advising a wide range of other telcos on day to day telecommunications contracts (ComTel, Commander, New Tel, NTT, People Telecom, PowerTel, Concert, Ivox, Century 21, Telcoinabox, Universal Telecoms).

Outsourcing

  • Advising Financial Synergy in relation to a project with a New South Wales Government Authority under which the Government outsourced the administration of all New South Wales public sector superannuation accounts.
  • Advising British Telecom in relation to its contract with the New South Wales Government to build operate and manage a private telecommunications network covering New South Wales.
  • Advising Total Communications Infrastructure (TCI) on its contracts with Vodafone Hutchinson Australia and Optus to outsource aspects of their mobile network development and construction activities.
  • Advising Duncan Solutions in relation to contracts with the cities of Chicago, Atlanta and Indianapolis for the outsourcing of on-street parking meter operations.
