Mr. Napoli practices commercial and securities litigation.

The securities matters on which Mr. Napoli has recently worked include serving as counsel to the court-appointed receiver for Retirement Value, LLC; defending individuals and entities in civil proceedings brought by the SEC and the Texas State Securities Board; prosecuting claims for securities fraud on behalf of individuals who had invested in a Ponzi scheme; defending a broker-dealer against allegations that a former employee had been involved in a Ponzi scheme; defending a broker-dealer accused of market timing; defending a mutual fund advisor against a class action asserting violations of state and federal law with respect to its handling of redemptions; and defending hedge funds in litigation arising from their purchase of convertible securities in small public companies.

Mr. Napoli also has a broad commercial practice including contract, corporate governance and intellectual property disputes. In recent years, he has prosecuted litigation on behalf of an automotive finance company against the servicer of its loan portfolio; defended directors of public companies accused of a breaching fiduciary duties; prosecuted and defended claims for misappropriation of trade secrets; prosecuted patent infringement and antitrust litigation on behalf of a vending machine company; and defended patent infringement and Lanham Act claims relating to oil field tools. 

In addition to his paying work, Mr. Napoli maintains an active pro bono practice involving, among other things, assisting parents obtain the return of their children under the Hague Convention on the Civil Aspects of International Child Abduction.
