Resident in the Palo Alto and Boston offices, Mr. Zeliger focuses his practice on complex civil litigation, with particular emphasis on patent and other intellectual property litigation. He is lead counsel for numerous technology companies, including those in the fields of vibration control systems, robotics, nonwoven materials, laboratory instrumentation, food processing and manufacturing.  Mr. Zeliger has experience at all stages of litigation including Markman and dispositive motions, jury and bench trials and appeals.

Professional Background

Prior to joining K&L Gates, Mr. Zeliger was a Principal in the Boston office of a national intellectual property law firm.  Mr. Zeliger has also taught trial practice with an emphasis on patent litigation at the Boston University School of Law.

  • CytoLogix Corp. v. Ventana Medical Systems, Inc.   (Slide based cellular diagnostics)  Led CytoLogix in numerous actions adverse to Ventana.  As plaintiff, recovered $49 million in a publicly disclosed settlement.  As defendant received dismissals, obtained settlements and paid no damages.
  • Fiberweb Simpsonville (and related entities) v. Baldwin Graphic Systems, Inc.  (Nonwoven manufacturing and fabrics)  Led Fiberweb in a multinational patent dispute resulting in a favorable settlement on the heels of a successful Markman hearing.
  • Dako Denmark  A/S v. Ventana Medical Systems, Inc.  (Slide based cellular diagnostics)  Led Dako to a favorable settlement immediately following a favorable Markman hearing. 
  • Dako Denmark A/S v. AsymmetRx, Inc. (Reagents for detecting prostate cancer)  Led Dako to a dismissal of a District Court Action, followed by a favorable settlement of a corresponding arbitration.
  • Ocean Spray Cranberries, Inc. Amazin Raisins, Inc.   (Food processing and manufacturing)  Led Ocean Spray to summary judgment of noninfringement, affirmed by the Federal Circuit.
  • Blockbuster Inc., et al v. Lycos, Inc.   (On-line recommendation systems)  Led Blockbuster to partial summary judgment of noninfringement and negotiated terms for favorable settlement of remaining claims.
  • ChoiceStream, Inc. v. Refined Recommendation, LLC (On-line recommendation systems)  Led ChoiceStream to an outright dismissal with prejudice, without damages.
