Ms. Summerville has more than 12 years' experience providing advice and guidance on major real estate transactions in Australia.

Ms. Summerville's expertise spans across all stages of the development lifecycle including acquisition and structuring through to disposal of assets, government projects, developments for commercial, industrial and mixed use projects, strata and community title and complex leasing (commercial, industrial and retail). She has a diverse client base acting for the government sector, local and overseas developers, institutions, corporate real estate clients and high net worth individuals.

  • Acting for NSW Land and Housing Corporation on the strategic conversion of residential leasehold properties to freehold in Millers Point and the acquisition of those properties by the existing tenants.
  • Acting for the NSW Police Force on the negotiation of a complex agreement for lease and lease for the new PolAir facility at Bankstown Airport.
  • Acting for Sydney Airport in relation to complex and stream leasing matters and general property advice.
  • Acting for a private client on a transaction with a coal mine company for AUD22 million. The deal involves the sale of land to the coal mine so that a rail line extension could be constructed through the property. In addition, the coal mine will transfer water entitlements and land to our client. The complex documentation deals with numerous issues including FIRB, planning approvals, easements, leases and fallback positions if subdivision can not be obtained.
  • Acting for an overseas developer on the sale of a significant building in Chinatown for AUD61 million with approximately 130 different tenancies.
  • Acting for McKinsey & Company in connection with an agreement for lease and lease for commercial space in a "to be constructed" premium grade office tower in Melbourne together with ongoing advice in respect to its premises around Australia.
  • Acting for Poly Australia in relation to the acquisition of an existing caravan park site in Rouse Hill for redevelopment.
  • Advising a private client with a substantial industrial property portfolio across NSW, QLD, SA and Tasmania all work associated with the portfolio management and leasing of the sites together with all sales and acquisitions and general property advice.
  • Acting for a private local developer with projects in Blacksmiths, McMahons Point and Kirribilli including advising on subdivision documentation, preparation of easements, bylaws, a building management agreement, master contract preparation and management of the conveyancing.
  • Acting for a local developer on the acquisition of a site in Hervey Bay for consolidation with existing titles and redevelopment.
  • Acting for NSW Land and Housing Corporation in relation to the development of a site within its Neighbourhood program.

Experience gained prior to joining K&L Gates includes:
  • Acting for Goodman on a development agreement with NSW Ports at the Enfield Intermodal Logistics Centre including several ancillary documents such as an agreement for lease, lease, builder's side deed and an independent certifier deed.
  • Acting for ANU and Macquarie University on the preparation of a suite of leasing documentation to be implemented following redevelopment.
  • Advising Waverley Council on easements, restrictions, leases and various agreements to determine the competing interests of relevant parties in the ownership of a car park.
  • Acting for five different strata schemes and each of the owners to draft documentation to facilitate the collective sale of all buildings to a developer.
  • Acting for a private developer on a complex subdivision at Wyee involving a flow water factory, a federal funding agreement, affordable housing arrangements with the local council, subdivisions and numerous easements.
  • Acting for a property developer on the acquisition of several sites from different owners to be amalgamated and sold following rezoning. The project involved complications including emergency orders issued by council, the creation of easements and subdivisions.
  • Acting for a foreign entity on the acquisition of one of the largest residential transactions in Australia (approx. AUD750 million). The transaction involved residential rezoning, subdivisions, easements, a voluntary planning agreement, numerous tenants and FIRB issues.
  • Acted for Becton on all aspects of a large multi tower mixed use staged development with 650 residential apartments, retail and commercial space including drafting of the master contract, strata management statement, easements, by laws, leases and management of the stream conveyancing by a team of paralegals.
  • Acted for one of Australia’s largest pastoral land owners and operators in Australia in relation to the sale and lease back of properties, including water entitlements, livestock and plant and equipment agreements.
  • Acted on the sale of bloodstock business and land holdings with a value in excess of AUD440million which involved the sale of numerous commercial, rural and residential properties, transfer of water licences and assignment of leases.
  • Acted for a developer on a broadacre subdivision including master contract preparation and stream conveyancing including "builder sales" by option - approximately 1,400 lots.
