Ms. Maughan concentrates her practice on labour, employment and workplace safety law. She has assisted many national and international clients across a variety of industries on employment and industrial relations issues.

Ms Maughan provides legal and strategic advice in relation to:

  • a range of employment claims, including breach of contract, unfair dismissal and adverse action claims
  • equal opportunity and occupational safety and health
  • employee performance management, misconduct issues and disciplinary processes
  • termination of employment advice, including with respect to redundancy and post-termination restraints
  • industrial relations, including enterprise agreement bargaining and drafting, industrial action and industrial disputation
  • employment terms and conditions, modern award and enterprise agreement compliance
  • commercial agreements, including employment contracts, contractor agreements and workplace policies and procedures.

During the period April 2016 to March 2017, Ms. Maughan was employed as an Associate to a Deputy President Member of the Fair Work Commission and in that role was responsible for the administration and operation of the Member's Chambers, undertaking research in the field of labour law and workplace relations, performing Clerk of Court functions in Commission hearings and conferences, and preparing and publishing listed matters, directions, orders and decisions.

Ms. Maughan also has experience in conducting workplace investigations and delivering workplace training on a variety of issues.

  • Advising clients on human resources issues, including employment contracts and policies, terminations of employment, managing independent contractors, equal opportunity issues, privacy and confidentiality, executive engagement and remuneration and resolving workplace disputes.
  • Advising clients on complex industrial relations and employment issues, including industrial relations strategy, enterprise bargaining and managing and resolving industrial disputes.
  • Conducting workplace investigations and preparing and drafting investigation reports concerning bullying and harassment.
  • Defending unlawful termination, unfair dismissal and general protections claims in the Fair Work Commission, the Federal Court of Australia and the Federal Circuit Court of Australia.
  • Advising clients on Modern Award interpretation and compliance.
  • Assisting with the preparation and drafting of obligations registers covering safety legislation in Australia.
  • Advising clients in the building and construction industry with respect to Code compliance and preparing Code compliant commercial agreements, workplace relations management plans and policies.
  • Developing training packages and materials for workplace inductions, equal opportunity and diversity training.
  • Preparing court, commission and tribunal documents for proceedings in the Federal Court of Australia, the Supreme Court of Western Australia, the District Court of Western Australia, the Fair Work Commission and the Road Freight Traffic Industry Tribunal.
