Court Overturns FCC’s Net Neutrality-Based Decision Against Comcast: What Happens Next?, Telecom, Media and Technology Alert, by Marc S. Martin, Martin L. Stern. April 8, 2010.


On April 6, 2010, the U.S. Court of Appeals for the District of Columbia Circuit (the “D.C. Circuit”) overturned a 2008 enforcement action by the U.S. Federal Communications Commission (“FCC”) against Comcast Corporation arising from allegations of Comcast engaging in unreasonable and discriminatory broadband network management practices.   This client alert will briefly summarize the court decision, discuss how it will affect the FCC’s efforts to adopt net neutrality rules and implement its recently adopted National Broadband Plan (the “Broadband Plan”),[1] address the potential for Congressional intervention, and explain how other federal and possibly state authorities could step in to fill the apparent void in FCC jurisdiction.

Over approximately the past year businesses have been experiencing an increased level of cyber-attacks designed to steal and misuse the user names and passwords to online banking accounts. Online thieves have been tapping into business bank accounts and ordering fraudulent wire transfers and Automated Clearinghouse (ACH) transactions, often to accounts in foreign countries from which recovery is very difficult. While this type of crime is not new, there are two novel aspects: the increasing sophistication of the hacking software and the nature of the counter-measures that are being recommended. Washington Post writer Brian Krebs provides a chilling and up-to-date view and a recent Forbes magazine article outlines how this development is impacting businesses.

In a declaratory judgment action filed by the company MyVideo (represented by K&L Gates Berlin) against CELAS, a joint venture of the German collecting society GEMA and the UK collecting society MCPS-PRS, the District Court of Munich (Landgericht München) decided on June 25, 2009, that CELAS has no right to prohibit reproductions of the Anglo-American repertoire of EMI Music Publishing Ltd. online in Germany.


BSI Launches First Data Protection Standard, Licensing and E-merging Commerce Alert, by Dominic J. Bray, Edward T. Parkin, Sarah L. Stone. July 1, 2009.

At the recent Data Protection Forum in London, BSI British Standard ("BSI") launched the new British Standard BS10012 entitled "Data Protection - specification for a personal information management system".  BSI claims this as the first standard for the management of personal information.  The standard is designed to assist organisations in both the public and private sectors in relation to compliance with the often complex area of data protection law.  The standard was developed over a 3 month consultation period by a panel of experts which included representatives from industry, government, academia and consumer groups.  Data protection has been steadily rising as a compliance priority for businesses globally.  The introduction of BS10012 adds to the call to businesses to check compliance with data protection laws.

Model Railroad Case Supports Enforceability of Open Source Software Licenses and Provides Guidance for Licensors, Licensing and e-Merging Commerce Alert, by Eric A. Prager, Mark H. Wittow, Jeffrey E. Harmes. September 5, 2008.

The United States Court of Appeals for the Federal Circuit recently issued an opinion that bolsters the enforceability of open source software licenses.  In Jacobsen v. Katzer, the Court held that a licensor providing free open source software properly can limit the further distribution of the software through terms in the open source software license requiring attribution credits to the original author.  The decision is important because the Court held that the party failing to provide credit required under the license violated copyright law.

This article concerns new federal regulations concerning "Affiliate Marketing" that will impact affiliated companies receiving and using certain information for marketing purposes.  The relevant information is information that would have been a "consumer report" (e.g., credit report) under the Fair Credit Reporting Act but for exceptions (which no longer really exist for marketing).  The rule imposes a new disclosure and "opt-out" regime. For some time utility companies in Europe have offered high-speed Internet service to consumers over their power lines, and American utilities are now beginning to provide broadband connections on their grid. There is a pervasive, national network of power lines which could be easily ( and economically) used to provide broadband access. This function has become known as Broadband Over Power Line ("BPL"). But the taxation of such services, which combine utility and telecommunications issues, presents a real challenge both to the taxing authorities and to taxpayers. The following is a review of some of the significant taxes and tax related legislative initiatives that will affect BPL, and some insight into how various government entities might seek to tax BPL and related services. Taxes may be imposed by both the federal and state governments depending on the BPL services provided.

Open source software presents issues of increasing significance for businesses. If you are not already familiar with these issues and your business is using or considering the use of open source software, it’s time to take note. This article analyzes considerations that businesses should keep in mind when deciding whether to use this type of software. As with any licensed technology, open source is governed by the terms of the open source license. Actively copying, modifying, developing products with, or distributing open source software without understanding those terms can jeopardize a company’s business endeavors. On the other hand, businesses that take the time to research and investigate open source licensing models and that are familiar with the issues described in this article are more likely to be successful in deciding whether and when to use open source.
