K&L Gates’ patent litigation team is defending several firm clients against patent infringement claims brought by Canadian-based company Emergis Corporation. Emergis claims to have a valid U.S. patent that covers various types of "on-line bill presentment and payment" methods. The patent at issue is U.S. Patent No. 6,044,362 (‘362).

Emergis has been systematically asserting claims of patent infringement against various types of companies—including utilities and co-operatives—that allow their customers to review and pay their bills over the Internet. Typically, Emergis sends a demand letter to a company about the company’s allegedly infringing activities and demands a significant royalty payment for a license to use the on-line bill payment system. If the company does not capitulate, Emergis files suit in federal court for alleged infringement of the ‘362 patent.
