K&L Gates’ product liability lawyers counsel clients on the full range of issues that can arise during the life cycle of a product, always with the goal of mitigating and reducing the risks of litigation, regulatory actions, and government investigations. When litigation does occur, our clients have entrusted our seasoned trial lawyers with the defense of thousands of cases, from the initial pleading stage through trial and appeal, coordinating the national, regional, and local defense in state and federal courts including mass tort proceedings, acting as national discovery and science counsel, and handling class actions and multidistrict litigation.

Our group understands that there is no “one size fits all” approach to any litigation and perhaps especially to mass tort litigation. Our experience has proven the importance of being fluid when it comes to assessing the best approach for defending a single case or thousands of cases.

Pharmaceuticals and Medical Devices
National and trial counsel in product liability litigation involving a global manufacturer of a drug used to reduce bleeding during heart surgery. Also assisted the client in making presentations to the FDA at Advisory Committee hearings about this same drug.
Conational counsel for one of the world’s leading manufacturers of branded pharmaceuticals in the defense of product liability claims involving an osteoporosis drug. Plaintiffs asserted that they suffered from hip and spinal fractures due to decreased bone density caused by the drug.
Counsel for a large pharmaceutical and medical device manufacturer in a joint criminal and civil investigation conducted by the U.S. attorney’s office in Chicago related to the sale of renal dialyzers that were allegedly contaminated in the manufacturing process. The products were associated with the deaths of approximately 70 people around the world. The investigation was closed with no criminal or civil enforcement proceedings.
Counsel for a major drug manufacturer in a series of related cases in which plaintiffs alleged that gadolinium-based contrast agents manufactured and/or distributed by the company and administered as part of MRI scans caused extensive medical problems due to reduced kidney function.
Counsel for a global pharmaceutical company in a nationwide class action stemming from a Hepatitis C outbreak, which focused on CDC and similar health care practitioner regulations, multi-use vials and the risk of infection, physician v. manufacturer responsibility for potential contamination, and labeling and design feasibility issues.
