Areas of Practice

Athan Tramountanas is a partner in the Seattle office.  His practice focuses on construction and contract law and complex commercial litigation.  He has advised public and private clients on various issues throughout the construction process, negotiated and drafted design and construction contracts, prepared various procurement documents, and successfully represented clients throughout the dispute resolution process in both trial and appellate courts.  Athan has served as lead counsel and second chair for bench and jury trials while working at K&L Gates and has tried criminal felony jury trials while participating in a trial fellowship program with the King County Prosecutor's office.  He has also served as a third-party neutral, assisting parties in resolving their disputes.

Athan co-authored chapters 3, 4, and 4.1 of the 2002 edition of the Washington Civil Procedure Deskbook .  He has also written several articles on construction law and has presented sections on construction law for government contracting and continuing legal education seminars.  Athan is a member of the Litigation and Construction Law sections of the Washington State Bar Association, and is a member of the Design-Build Institute of America.

Contract Claims Appellate Court Decisions
  • American Safety Casualty Ins. Co. v. Olympia, 162 Wn.2d 762; 174 P.3d 54 (2007).  Successfully obtained summary dismissal of a contractor's claims against a public owner of wastewater treatment facilities where the contractor failed to comply with contractual claims requirements.
  • Crest, Inc. v. Costco Wholesale Corp.,128 Wn. App. 760; 115 P.3d 349 (2005).  Represented a general contractor and successfully defended claims by a subcontractor that was made to remove and replace defective work.
  • LHT Corp. v. Kelly & Associates, P.S., No. 53213-8-I, 2005 Wash. App. LEXIS 103 (2005).  Represented a building owner in a dispute against a tenant for damages, successfully recovering all contract damages and attorneys fees.

Professional Background
Prior to entering law school, Athan worked as a construction project engineer for a general contractor and developer. During law school, Athan was an associate editor of the Seattle University Law Review and he earned CALI awards in Legal Writing, Contracts, Property, and Intellectual Property.
