This program highlights aspects of the Telephone Consumer Protection Act (TCPA). Businesses need to communicate with their customers, prospects, and employees efficiently and effectively. Phone communications, including calls and text messages, are subject to an archaic federal law that is a favorite of regulators and the plaintiffs’ bar--the TCPA. The regulations for the TCPA were recently clarified by the FCC, and common practices may no longer be appropriate. The good news is there are some practical steps businesses can consider to help avoid liability when calling or texting, and when contracting with vendors to do so on their behalf.
