Stephen McCrae focuses his practice on commercial real estate development, land use and zoning, and governmental relations. He also serves as the client representative for a number of foreign-based/owned companies with South Carolina operations.

In addition, Mr. McCrae served as a member of the 2003 Advisory Council appointed by the Director of the South Carolina Department of Revenue on the simplification of Fee in Lieu of Taxation statutes.

Mr. McCrae is a LEED Accredited Professional (LEED-AP), a distinction he earned through the Green Building Certification Institute. As a LEED-AP, he has demonstrated a thorough understanding of green building practices and principles, as well as the LEED Rating System.

  • Represented international bank as local counsel in the attempted loan restructure secured by a large entertainment venue and subsequent  bankruptcy-court approved sale of the collateral by the client.
  • Representing an international financial institution in the pending judicial foreclosure of its mortgage, as Collateral Agent, with respect to a $44 million development loan and appointment of a receiver pending foreclosure.
  • Representing a regional bank in two judicial foreclosure actions involving commercial tracts under development and the restructuring of a related debt facility aggregating approximately $16 million.
  • Represented largest developer in York County on development, zoning and other governmental relations issues regarding development of 6,000 acres into neighborhoods/villages of mixed residential (including single-family, townhouse and multi-family), commercial, retail and civic uses.   
  • Advised and counseled Rock Hill area developer regarding development, financing, leasing and various land use issues in the development of the largest-to-date, mixed-use project (containing 125 acres) within the City of Rock Hill.   
  • Represented Master Developer of 1,437-acre tract in obtaining a Development Agreement and other entitlements from York County for a mixed-use development, including a 300-acre Office/R&D site.
  • Served as local counsel to national lending entities in numerous large credit facility matters regarding real estate and lending issues.   
  • Advised both U.S. and foreign-owned companies regarding state and local economic incentives for establishing operations in South Carolina, including negotiating Fee in Lieu of Taxation agreements.
