Mr. Fisher advises large multinational corporations, middle market businesses and emerging companies in negotiating, structuring, and drafting their commercial agreements, with an emphasis on outsourcing agreements, technology licensing agreements, information technology services agreements, hardware purchase agreements, and manufacturing and distribution agreements. Mr. Fisher also has represented Fortune 500 companies in all aspects of their defense of commercial disputes involving a variety of claims, including breach of contract, breach of fiduciary obligations, products liability, negligence, gross negligence and conspiracy.

Mr. Fisher is a founder of the Association of Technology Law Professionals, a member-based organization of in-house lawyers who are responsible for technology, outsourcing, procurement, and similar commercial transactions at their companies. The group was formed to allow in-house lawyers to share best practices and discuss trends and issues in technology, outsourcing, and commercial transactions.

Mr. Fisher also was a founder of The Emerging Growth Series, an interactive seminar series aimed at providing entrepreneurs and emerging growth companies with the resources and information needed to grow their business. The series, which was sponsored by K&L Gates, Ernst & Young, JPMorgan Chase and STARTech Foundation, ran for more than four years.

Mr. Fisher is a founder of Legal Cloud Central (www.legalcloudcentral.com), a blog focused on issues and developments involving cloud computing (Software as a Service (“SaaS”), Infrastructure as a Service (“IaaS”), and Platform as a Service (“PaaS”)).

  • The representation of Ericsson Inc. in structuring and negotiations of a seven-year Managed Network Services Agreement with Sprint.  The agreement, valued between $4.5 and $5 billion, involves Ericsson assuming responsibility for the day-to-day services, provisioning, and maintenance of Sprint's CDMA, iDEN, and wireline networks.
  • The representation of Electronic Data Systems Corporation (EDS) in structuring and negotiations of its multi-billion dollar global information technology outsourcing relationship with American Airlines.
  • The representation of Blockbuster Inc. in structuring and negotiations of its promotional agreements with America Online and Napster for Blockbuster's online DVD subscription rental service.
  • The representation of multinational telecommunications company in outsourcing its human resources operations for its U.S., Canada, Brazil and Mexico operations.
  • The representation of EDS in structuring and negotiations of its information technology outsourcing agreement with Allegheny Energy, Inc.  With this agreement, EDS will manage Allegheny's applications, desktops, midrange servers and communications networks. EDS will also lead a consortium comprising EDS, Deloitte Consulting and A.T. Kearney for an ERP application software implementation.
  • The negotiation of wireless content licensing agreements on behalf of CNET Networks, Inc. (CNET) with Sprint PCS and Nextel, respectively.
  • The representation of Koss Corporation in negotiations of various manufacturing, distribution and licensing agreements related to its line of stereophones.
  • The representation of EDS in a global strategic partnership between EDS, A.T. Kearney and i2 Technologies, Inc. that enables the parties to deliver technology-enabled strategic sourcing, supplier management, procurement and content solutions for e-marketplaces and industry verticals.
