Ms. Tran is a commercial litigator with particular involvement in large scale complex matters in the Supreme Court and the Federal Court. She is highly experienced in running proceedings concerning trade practices, financial services, property and construction, commercial disputes, professional negligence and insurance claims. She has also acted in some of the largest shareholder class actions and Commonwealth regulator enforcement proceedings in Australia.

Ms. Tran's approach to advocacy is sensible but robust. Her meticulousness and timeliness in that approach have led to many wins and favourable settlements for her clients.

Ms. Tran typically represents large corporations and major insurers in Australia.

Professional Background

Before joining K&L Gates, Ms. Tran held similar senior positions at various leading Sydney private firms including, in 2015, a secondment to the Australian Securities and Investments Commission where she assisted in all aspects of the Commission's investigation under the Future of Financial Advice reforms.

  • Represented key personnel of the Australian and New Zealand Bank in the Australian Securities and Investments Commission's bank bill swap rate investigation concerning alleged market manipulation and related conduct by the big 4 in contravention of the Corporations Act 2001 (Cth) and the Australian Securities and Investments Commission Act 2001 (Cth). 
  • Represented investors in shareholder class actions relating to alleged misleading valuations, non-disclosure and inadequate disclosure, and other forms of misrepresentations to the market. 
  • Brought and defended claims under the Trade Practices Act 1974 (Cth) and the Competition and Consumer Act 2010 (Cth) involving misleading and deceptive conduct, concurrent wrongdoers and time limitation issues. 
  • Advised on and defended professional negligence claims, including defending liability of a quantity surveyor to Westpac for alleged loss of $39 million advanced under a construction loan facility, bringing claims concerning common law duty of care of designers and manufacturers to a purchaser of goods and that of a principal certifying authority to a purchaser of property, and acting in claims concerning alleged negligent professional advice. 
  • Advised on and acted in various complex commercial disputes, including taxation liability arising from off-market share buy-backs, accounting of assets and liabilities in a business sale context, alleged breaches of terms of share sale agreements and services agreements, and validity of an expert determination of 'fair market rent'.
