Mr. Denny is a real estate lawyer with more than 25 years' experience in property, development and construction law and leads a talented and versatile team of experienced senior associates, support lawyers and paralegals in the Brisbane office. His team advises on a wide range of real estate transactions including commercial, office, industrial, bulky goods and retail leasing and sales and office and business park developments. Mr. Denny's experience includes preparing and negotiating put and call options and contracts for acquisition subject to conditions, title structures, agreements for construction and lease, incentive arrangements, fund through and conventional financing arrangements, construction contracts and preparing contracts for the sale of the completed development.

Mr. Denny's team focus on strata title residential, commercial and mixed use developments, aged care, receiver and mortgagee sales, development and joint venture agreements, title structures, staged developments and real estate dispute resolution. Mr. Denny and his team are skilled in structuring commercial arrangements, drafting complex agreements and contract negotiation. Mr. Denny also has 20 years' experience in acting for developers in the preparation and negotiation of construction contracts.

  • Acting for Port of Brisbane in the sale of non-strategic port land under complex arrangements for sale with development covenants involving term payments and imposing an obligation on the developer to develop the land over a set time frame.
  • Acting for Metcash in preparing and negotiating agreements for construction and lease, major tenant leases, and subleases to the retailer in the roll out of supermarket and liquor stores in Australia.
  • Acting for the developer on various strata title residential developments in Queensland. Recent projects include:
    • Victoria Park Residences - 104 strata title units at Kelvin Grove
    • Landmark - 118 strata title units at Kelvin Grove
    • Pavillions – 204 units and retail complex in two stages on volumetric title.
  • Acting in the acquisition or sale of numerous shopping complexes and office buildings, subject to leases on the East Coast of Australia.
  • Acting for Wagners in advising and preparing documents for the land use, infrastructure servicing and community title scheme being established for the Wellcamp Airport and Business Park Development in Toowoomba. This facility is designed to accommodate jet aircraft, domestic and international travel.
  • Acting for Alceon in negotiating a development agreement with a Queensland State Government instrumentality to develop a series of commercial office complexes over a five year time frame.
  • Acting for McKenzie Aged Care in relation to site acquisitions and other issues in relation to Aged Care facilities operated by McKenzie Aged Care in Queensland.
