Merger/Authorisation Clearance

Obtained informal public review clearance from the ACCC on behalf of GlobalX in respect of its acquisition by Dye & Durham for ~$170 million (supply of search services to law firms and banks, conveyancing software services and practice management software to law firms).
Obtained pre-assessment clearance from the ACCC for Visy's ~$1 billion acquisition of Owen-Illinois' (the largest glass manufacturer in the world) glass manufacturing and beneficiation business in Australia.
Obtained pre-assessment clearance from the ACCC for Americold's acquisition of Agro Merchant Group (global transaction value totaled USD1.7 billion), as well as acting for Americold on various potential acquisitions in the cold chain logistics supply industry.
Obtained ACCC clearance on behalf of HP in respect of certain resale price maintenance (RPM) conduct on online market places, as well as obtained authorisation clearance from the NZCC (for the first time since its inception) on behalf of HP in respect of certain RPM conduct on both its online store and online marketplaces.
Obtained ACCC clearance on behalf of a group of pharmaceutical wholesalers in an application for Authorisation to enable urgent COVID-19 related industry collaboration regarding supply chain arrangements, including reauthorisation for these arrangements and enabling the industry association, NPSA, to collectively negotiate with the Department of Health in respect of COVID-19 Vaccines distribution.
Obtained interim authorisation and draft determination from the ACCC on behalf of the major car rental companies (Avis, Budget, Thrifty, Hertz, Thirfty, Europcar and Enterprise) to collectively bargain with Cairns Airport in relation to the acquisition of airport space associated with the provision of car rental services at the airport (application withdrawn due to COVID-19 related impacts).

Cartel and Misuse of Market Power Investigations/Proceedings

Assisted Engage Marine, the complainant that initiated the ACCC's proceedings against Tasmanian Ports Corporations, the first such proceedings under the new s46 'misuse of market power' provision.
Assisting various interested parties, including immunity applicant and derivative immunity applicants in landmark cartel proceedings, including in CDPP v The Country Care Group & Ors, ACCC v ANZ (representing senior JP Morgan executives), Citibank & Ors, ACCC v BlueScope Steel & Ors, as well as assisting clients in internal cartel investigations.

Other Notable Matters

Completed over 9 Australian consumer law and competition law compliance program reviews for various companies in the hearing aid, roofing materials and online booking marketplace industry.
Successfully completed a comprehensive review of an automative client's consumer guarantees processes to ensure compliance with the Australian Consumer Law.
Completed a comprehensive review of a large IT client's distribution channel and rebate program changes as against competition and consumer law in Australia and New Zealand.
